ORDINANCE NO. 7981
® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED FOR THE
EXCHANGE OF ASH STREET FOR LOTS SIX (6) AND SEVEN (7), BLOCK SIX
(6) OF CASEY ADDITION, BAYTOWN, HARRIS COUNTY, TEXAS; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, Grace S. Kelley, has built a house on property which is platted as Ash Street; and
WHEREAS, Lots Six (6) and Seven (7), Block Six (6) of Casey Addition is contiguous to and
contains the same acreage as Ash Street; and
WHEREAS, the City has yet to make any improvements to Ash Street; therefore, the exchange
of the properties will not be detrimental to the City of Baytown; and
WHEREAS, the exchange of properties is necessary to accurately reflect the existing conditions
in the Casey Addition; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section l: That the City Council of the City of Baytown, Texas, hereby authorizes the
mayor of the City of Baytown to execute a Quitclaim Deed, attached hereto as Exhibit "A," for the
exchange of the property described in the Warranty Deed, attached hereto as Exhibit "B."
Section 2: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ AND PASSED by the City Council of the City of Baytown this the
22nd day of May, 1997.

THAT, the CITY OF BAYTO WN, a municipal corporation located in Harris and
Chambers Counties, Texas, ( "Grantor "), for and in consideration of the conveyance of real
property of the same date as this instrument from the Grantee named below to Grantor, the
receipt and sufficiency of which are acknowledged by Grantor, hereby RELEASES, REMITS,
AND QUITCLAIMS unto GRACE S. KELLEY, ( "Grantee), whose address is 1510 Cedar
Bayou Road, Baytown, Harris County, Texas, the following described property ( "Property "):
That portion of Ash Street, located in Baytown, Harris County Texas, which
separates Lots Six (6) and Seven (7), Block Six (6) from Lots One (1) and Twelve
(12), Block Seven (7) of the Casey Addition to Goose Creek, Texas; being a
subdivision of the North part of the Julia Casey tract out of the Whitney Britton
Survey in Harris County, Texas, according to the map or plat thereof filed of
record in the Deed Records of Harris County, Texas in Vol. 532 at Page 27, to
which reference is here made.
TO HAVE AND TO HOLD THE PROPERTY, together with all and singular the rights
and appurtenances belonging in any way to the Property, unto Grantee, her successors and
assigns forever.
By deed of the same date as this instrument, Grantee has conveyed to Grantor the
property described in that deed as consideration for the conveyance from Grantor to Grantee in
this instrument. Grantor and Grantee agree that no lien, either express or implied, shall arise in
favor of Grantor or Grantee as a result of the exchange of property between Grantor and Grantee.

Harris County, Texas, ( "Grantor "), for and in consideration of the conveyance of real property of
the same date as this instrument from the Grantee named below to Grantor, the receipt and
sufficiency of which are acknowledged by Grantor, has GRANTED, SOLD, and CONVEYED,
and by these presents does GRANT, SELL, and CONVEY to the CITY OF BAYTOWN, a
municipal corporation located in Harris and Chambers Counties, Texas, ( "Grantee), the
following described property ( "Property "):
Lots Six (6) and Seven (7), Block Six (6) of the Casey Addition to Goose Creek,
