ORDINANCE NO. 7966
® AN ORDINANCE AUTHORIZING CHANGE ORDER NO. 2 WITH RWL
CONSTRUCTION, INC., FOR THE PLUMWOOD SANITARY SEWER
REHABILITATION PROJECT; AUTHORIZING PAYMENT BY THE CITY OF
BAYTOWN, THE SUM OF SEVENTEEN THOUSAND FORTY -ONE AND 50/100
DOLLARS ($17,041.50); MAKING OTHER PROVISIONS RELATED THERETO;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council does hereby authorize Change Order No. 2 with RWL
Construction, Inc., for the Plumwood Sanitary Sewer Rehabilitation Project. A copy of said change order
is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes.
Section 2: That the City Council of the City of Baytown hereby authorizes the payment of
SEVENTEEN THOUSAND FORTY -ONE AND 50/100 DOLLARS ($17,041.50) to RWL Construction,
Inc., for Change Order No. 2 for the Plumwood Sanitary Sewer Rehabilitation Project.
Section 3: That pursuant to the provisions of Texas Local Government Code Annotated §
252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND NO / 100 DOLLARS ($15,000.00) or less,
subject to the provision that the original contract price may not be increased by more than twenty -five
percent (25 %) or decreased by more than twenty-five percent (25 %) without the consent of the contractor
to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of

Dear Mayor and City Council:
Your approval is requested on the following adjustment of original bid quantities and
additional freight and handling costs associated with the additional materials.
The Contractor hereby agrees to perform the additional quantities of work as requested by the
Owner and listed below. Such work will be performed for the original bid prices for each
item of work.
Bid Item Numbers 1, 21 5, 7, and 11 are hereby increased by 410 linear feet; Bid Item No. 3
is hereby increased by nine (9) each; Bid Item No. 4 is hereby increased by nine (9) vertical
feet; Bid Item No. 8 is hereby increased by one (1) each;a, Bid Item No. 10 is hereby increased
by 50 linear feet. These previously listed additional materials will be installed in an eastward
direction from M.H. No. P -27 and within the rear lot easement between Bruce and Colby
Drives in Plumwood Subdivision to a point of terminus at C.O. No. P-45A, which shall be
replaced as M.H. P-45A (Bid Item No. 8 below.)

An extension of time is being requested due to unseasonable wet weather which has caused
delays during and after rainfall events. The back lot easements have been extremely wet and
difficult to access with equipment to install liner and reconnect services. Also, the time
extension covers the 410 feet of additional work requested.
Change Order No. 2 represents an increase of 3.386/o in the Original Contract Amount.
Change Order No. 1 and No. 2 represent an increase of 4.84% in the Original Contract
Amount.

A 0.9117 acre tract of land (called 0.8957 acre tract of land) out of Block 140, of Elena Fruit &
Cotton Farms, Unit "D", Harris Counry, Texas as surveyed on the ground December 6, 1996,
under the supervision of Lee E. Horacefield, Jr. R-P.L.S. No. 1921, being all of that certain 0.8957
