ORDINANCE NO. 7930
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, CANCELING THE MUNICIPAL ELECTION PREVIOUSLY ORDERED
TO BE HELD ON THE 3RD DAY OF MAY, 1997, FOR THE PURPOSE OF
ELECTING THREE (3) COUNCIL MEMBERS FROM THE RESPECTIVE
DISTRICT NOS. ONE (1), TWO (2), AND THREE (3); DECLARING
UNOPPOSED CANDIDATES ELECTED TO OFFICE; ORDERING THE CITY
CLERK OF THE CITY OF BAYTOWN, TEXAS, TO POST THIS ORDINANCE
AT EACH POLLING PLACE ON THE ELECTION DAY; AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.
WHEREAS, through Ordinance No. 7883 of the City Council of the City of Baytown, Texas,
the City Council called its municipal election to be held on the 3rd day of May, 1997, for the purpose
of electing the following members of the City Council:
Councilmember from District One;
Councilmember from District Two; and
Councilmember from District Three; and
WHEREAS, only one candidate filed in each of the following districts: District No. One,
District No. Two, and District No. Three; and
WHEREAS, the deadline has now passed for declaring write -in candidacy in such election;
and
WHEREAS, Section 2.051, et seq. of the Texas Election Code provide for the cancellation
of an election if each candidate whose name is to appear on the ballot is unopposed and no
proposition is to appear on the ballot; and
WHEREAS, the City Clerk, the authority responsible for having the official ballot prepared,
has certified in writing that all candidates are unopposed for election to office and that no candidate's
name is to be placed on a list of write -in candidates for that office under applicable law; and
WHEREAS, the City Clerk has delivered to the City Council of the City of Baytown, which
certification is attached hereto as Exhibit "A" and is incorporated herein for all intents and purposes;
NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the Municipal Election ordered by the City Council of the City of Baytown
in Ordinance No. 7883, to be held on the 3rd day of May, 1997, for the purpose of electing the
following members of the City Council:

® Councilmember from District No. One;
Councilmember from District No. Two; and
Councilmember from District No. Three
is hereby canceled.
Section 2: That the City Council of the City of Baytown declares that each of the following
candidates are elected as Councilmembers of the single member districts opposite their respective
names:
Emilio Victor Almendarez
Scott Sheley
Manuel Escontrias
Council District No. One
Council District No. Two
Council District No. Three
Section 3: The City Clerk is hereby directed to post a copy of this ordinance on election
day at each of the polling places prescribed in Ordinance No. 7883.
Section 4: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown on this the 27`h day of March, 1997.
