ORDINANCE NO. 7906
® AN ORDINANCE REPEALING SECTION ONE (1) OF ORDINANCE NO. 7837,
REJECTING THE BID FOR VEHICLES FOR ITEM NO. 1 TO ORANGE FORD,
AND AWARDING THE BID TO BUDDY CHEVROLET; AUTHORIZING
PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF TWENTY -SIX
THOUSAND THREE HUNDRED NINETY -TWO AND NO /100 DOLLARS
($26,392.00); MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City Council of the City of Baytown, Texas, passed Ordinance No. 7837 on
October 24, 1996, awarding the bid for the purchase of vehicles to various companies; and
WHEREAS, Item 1 of such bid was awarded to Orange Ford for two small '/2 ton trucks.
Upon receipt of the trucks, it was discovered that they did not meet the required specifications; and
WHEREAS, the City is desirous of rejecting Item I of the bid for vehicles to Orange Ford
and awarding such bid to Buddy Chevrolet; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby repeals Section One (1)
of Ordinance No. 7837, rejects the bid for vehicles for Item I to Orange Ford in the amount of
TWENTY -SIX THOUSAND TWO HUNDRED FIFTY -TWO AND NO 1100 DOLLARS
($26,252.00) and awards such bid to Buddy Chevrolet. in the amount of TWENTY -SIX
THOUSAND THREE HUNDRED NINETY -TWO AND NO/ 100 DOLLARS ($26,392.00).
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§ 252.048, the City Manager is hereby granted general authority to approve any change order
involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N011 00 DOLLARS
($15,000.00) or less, subject to the provision that the original contract price may not be increased by
more than twenty -five percent (25 %) or decreased by more than twenty -five percent (25 %) without
the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City Council of the City
of Baytown this the 27th day of February, 1997.
