® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
ADDING A SIX ACRE TRACT OF LAND SOUTH OF TRUCK STOPS OF
AMERICA AT INTERSTATE 10 AND THOMPSON ROAD TO COUNCIL
DISTRICT NO. 4; REPEALING ORDINANCES INCONSISTENT HEREWITH;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
PUBLICATION AND EFFECTIVE DATE THEREOF.

WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City
Council shall redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a
Council District; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 4 is hereby redistricted by the addition of certain property
which is described on the attached Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause
or phrase of this ordinance or the application of same to any person or set of circumstances, shall
for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their application to other persons or sets of
circumstances and to this end all provisions of this ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its passage
by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption
of this ordinance to be published in the official newspaper of the City of Baytown at least twice
within ten (10) days after passage of this ordinance.

of Baytown this the 26th day of November, 1996.

FIELD NOTES of a 6.00 -acre tract situated in the William Hilbus Survey Abstract
No. 336 Harris County, Texas, being out of Unit "D" of the Elena Fruit and
Cotton Farm Subdivision as recorded in Volume 7, Page 48, of the Harris
County Map Records being out of and part of 208.605 -acre tract conveyed to
Floyd Woods recorded under County Clerk File No. R699461 of the Real
Property Records of Harris County, Texas.
Commencing at a '/2' iron rod found for the southwest corner of T. A, Operating
Company tract recorded under File No. P611282 being the northwest corner of
the said 208.605 -acre tract being in the easterly right -of -way of Thompson Road;
Thence south 02 040'38" east along the easterly right -of -way of Thompson Road
a distance of 408.09 feet to a 112" iron rod set for the northwest corner of the
"point of beginning" of the herein described tract;
Thence north 86 053'46" east parallel to the north line of the 208.605 -acre tract a
distance of 556.91 feet to a 112" iron rod set for the northeast corner;
Thence south 02 040'38" east along the east line of this tract being parallel to
Thompson Road a distance of 469.32 feet to a 1/2" iron rod set for the southeast
corner;
Thence south 86 053'46" west parallel to the north line a distance of 656.91 feet
to a 1/2" iron rod set in easterly right -of -way line of Thompson Road for the
southwest corner;
Thence north 02 140'38" west along the easterly right -of -way of Thompson Road
a distance of 469.32 feet to the "point of beginning" and containing 6.00 acres of
land.
