ORDINANCE NO. 7809 ® AN ORDINANCE AMENDING CHAPTER 3'/2 ALARMS," SECTION 3'/2 -4 "PERMIT ISSUANCE AND RENEWAL" OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, PROVIDING A REPEALING CLAUSE, CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 3'h "Alarms," Section 3'/2 -4 "Permit Issuance and Renewal," of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: CHAPTER 3' /z ALARMS Sec. 3%2-4. Permit Issuance and Renewal. (a) A permit cannot be transferred to another person. (b) Should the primary or secondary person designated to respond to an alarm site or any other information provided in the application for a permit change at any time during the term of the permit, the permit holder must notify the City in writing within ten (10) days of the change. (c) A business permit is issued for one year and is renewable annually. It is the responsibility of the permit holder to submit an application for renewal at least ten (10) days prior to the permit expiration date. (d) A residential permit need not be renewed as long as the permit holder continues to own the residence. Upon transfer of ownership of the residence, the residential permit automatically expires. (e) All residential permits issued before September 26, 1996, are hereby declared to be valid for the same length of time as they would be if issued on or after September 26, 1996. Section 1 All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of the other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause ® or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the 960926 -1a remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
