ORDINANCE NO. 7795 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING A MAXIMUM PRIMA FACIE SPEED LIMIT OF 30 MILES PER HOUR FOR MOTOR VEHICLES IN THE EORACE MANN JUNIOR SCHOOL ZONE; PROVIDING FOR HOURS OF ENFORCEMENT ON SCHOOL DAYS; AUTHORIZING AND DIRECTING THE PLACEMENT OF SIGNS BY THE DIRECTOR OF PUBLIC WORKS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 DOLLARS ($200.00); AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. 960912 -18 WHEREAS, pursuant to Article 6701 D, Vernon's Texas Civil Statutes, authorizing alteration of maximum prima facie speed limits with respect to streets and highways within the corporate limits of the City of Baytown based upon engineering and traffic investigations and requested public hearings; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That a special hazard exists to traffic safety in the vicinity of Horace Mann Junior School on days when school is in session and at times when students and other traffic approach and depart from the vicinity of such school and the City Council hereby makes such findings and determines and declares that the maximum prima facie speed limit to be reasonable, prudent and lawful is 30 miles per hour at the following location and times: Along Business 146 a school speed zone from a point 160 feet south of Republic Street to 1,216 feet south of Republic Street, a distance of approximately 0.200 miles, between the hours of 8:00 a.m. and 8:30 a.m. and 3:30 p.m. and 4:30 p.m. Section 2: The Director of Public Works is authorized and directed to place the appropriate signs at the above described locations. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. 960912 -18a Section 5: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than One and No /100 Dollar ($1.00) nor more than Two Hundred and No /100 Dollars ($200.00) except minors who have passed their -14th birthday but have not.reached their..17th.birthday shall be. punished by a fine of not more than One Hundred and No /100 Dollars ($100.00). Section 6: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
