ORDINANCE NO. 7774
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
ADDING CERTAIN PROPERTY TO COUNCIL DISTRICT NO. 4; REPEALING.
ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS
CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE
DATE THEREOF.

WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City
Council shall redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a
Council District; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 4 is hereby redistricted by the addition of certain property
which is described on the attached Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause
or phrase of this ordinance or the application of same to any person or set of circumstances, shall
for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their application to other persons or sets of
circumstances and to this end all provisions of this ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its passage
by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption
of this ordinance to be published in the official newspaper of the City of Baytown at least twice
within ten (10) days after passage of this ordinance.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown this the 22nd day of August, 1996.

A 2.408 -acre tract, more or less, out of Block NINETEEN (19) of HIGHLAND
FARMS, an addition in Harris County, Texas, according to the map or plat thereof
recorded in Volume 10, Page 47 of the Map Records of Harris County, Texas, and
being more particularly described by metes and bounds on Exhibit "A" attached
hereto.

Field note description of a tract or parcel of land out of a part of that certain 19.14 -acre tract of land
out of a part of that certain tract conveyed by the United States of America to J. F. Kubelka in deed
of record in Vol. 1325 at Page 28 of the Deed Records of Harris County, Texas, said tract of land
being out of the James Williams Survey, W.C.R.R. Survey No. 1 and the Ashbel Smith Survey,
Harris County, Texas, aforesaid 19.14 -acre tract now owned by John F. Fehring et ux, said tract of
land described as follows:
BEGINNING at a 518" steel rod situated at the Southeast corner of a 5 -acre tract owned, by Allen
Ray Branch et ux, said beginning corner situated in the centerline of a drainage ditch and further
described as being the Northeast corner aforesaid John F. Fehring et ux 19.14 -acre tract;
THENCE South 09 deg. 33 min. East along the centerline of said drainage ditch, the east line
aforesaid John F. Fehring 19.14 -acre tract and the East line of tract described a distance of 232.375
feet to a 518" steel rod set for corner, said corner being the Southeast corner of tract described and
further described as being North 09 deg. 33 min. West a distance of 232.375 feet from the
Southeast corner aforesaid John F. Fehring et ux 19.14 -acre tract;
THENCE South 79 deg. 41 min. West into aforesaid John F. Fehring et ux 19.14 -acre tract, and
along the South line of tract described, said line parallel to the South R -O -W line of Sharon Lane
a nondedicated 60 -foot R -O -W, a distance of 449.18 feet to a 518" steel rod set for the Southwest
corner of tract described;
THENCE North 10 deg. 38 min. West along the West boundary line of tract described a distance
of 232.36 feet to a 314" galv. pipe found at the Southwest corner of a 5 -acre tract owned by Allen
Ray Branch et ux, said corner situated as the North line of aforesaid John F. Fehring et ux 19.14 -
acre tract, being the Northwest corner of tract described;
THENCE North 79 deg. 41 min. East along the North line aforesaid John F. Fehring et ux 19.14 -
acre tract, the South line of a 5 -acre tract owned by Allen Ray Branch et ux and the North line of
tract described, said line parallel to the South R -O -W line of Sharon Lane, a distance of 453.57 feet
to the "PLACE OF BEGINNING ", enclosing within the boundary lines described 2.408 acres of land
more or less.
