Ordinance No. 7,768960808 -3 ORDINANCE NO. 7768 ® AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN, TEXAS, TO EXECUTE AN AMENDMENT TO THE INTERLOCAL AGREEMENT FOR THE HARRIS COUNTY ORGANIZED CRIME AND NARCOTICS TASK FORCE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, The City Council of the City of Baytown approved Resolution 1268 on December 14, 1995, authorizing the City of Baytown to apply to the Criminal Justice Division of the Office of the Governor of the State of Texas for a Texas Narcotic Control Program Grant for the Harris County Organized Crime and Narcotics Task Force; and WHEREAS, the City of Baytown and the City of Houston have entered into an Interlocal Agreement for participation and cooperation with the Task Force in the investigation, prosecution and prevention of organized and narcotics- related crime; and WHEREAS, the City of Baytown and the City of Houston seek to amend the Interlocal Agreement to include all services pertaining to analysis, storage, preservation and destruction of all illicit drugs and narcotics seized by the Harris County Organized Crime and Narcotics Task Force; and WHEREAS, the amendment to the Interlocal Agreement will authorize the City of Houston Police Department Crime Lab to perform all crime analysis, storage and disposal services in consideration for the amount of $34,290 to be reimbursed to the City of Houston from the grant funds; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Manager of the City of Baytown is hereby authorized to execute the attached Exhibit "A," the First Amendment to the Interlocal Agreement for the Harris County Organized Crime and Narcotics Task Force whereby the City of Houston will perform analysis, storage, and disposal services for all illicit drugs or narcotics seized and submitted to the Houston Police Department Crime Lab by the Task Force. The amendment to the Interlocal Agreement authorizes payment in the amount of $34,290 to the City of Houston for these services, payment to be made from the grant from the Office of the Governor, Criminal Justice Division. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. HALL, City Clerk APPROVED AS TO FORM: 0 c:\ council \meetings \august \amdhcoc.agr • FIRST AMENDMENT TO INTERLOCAL AGREEMENT FOR THE HARRIS COUNTY ORGANIZED CRIME AND NARCOTICS TASK FORCE THIS FIRST AMENDMENT TO INTERLOCAL AGREEMENT FOR THE HARRIS COUNTY ORGANIZED CRIME AND NARCOTICS TASK FORCE (the "First Amendment ") is made on the date of countersignature by and between the CITY OF HOUSTON, TEXAS (the "City"), a municipal corporation and home -rule city of the State of Texas, principally situated in Hams County, Texas, acting by and through its governing body, the City Council, and THE CITY OF BAYTOWN ( "Baytown ") AIINESSEIH WHEREAS, pursuant to Ordinance No. 96 -203, dated February 28, 1996, the City entered into an interlocal agreement for the Harris County Organized Crime and Narcotics Task Force (the "Original Contract ") with Baytown; and WHEREAS, the parties desire to amend the Original Contract to include services provided by the Houston Police Department Crime Lab ( "Lab "); and WHEREAS, Baytown agrees to reimburse the City in the amount of $34,290 for equipment costs related to Lab services; NOW, THEREFORE, the City and Baytown amend the Original Contract as follows: I Article III of the Original Contract is amended to include Section 3.05 which reads: Houston agrees to perform those services described as analysis, categorizing, tagging, storage, preservation and court - ordered destruction of all illicit drugs /narcotics seized and submitted by EXHIBIT "A" Page I of 3 is personnel assigned to the Force. Such services are to be provided by the Houston Police Department Crime Lab. As consideration for such services, Baytown agrees to reimburse Houston in the amount of $34,290 for equipment costs incurred by the Houston Police Department Crime Lab. II In the event of a conflict between the Original Contract and this First Amendment, this First Amendment shall prevail. IN WITNESS HERE OF, the City and Baytown have made and executed this Contract in multiple copies, each of which is an original.
