ORDINANCE NO. 7715
® AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR THE PUBLIC
HEARINGS ON THE PROPOSED ANNEXATION OF A 9.8099 ACRE TRACT
BELONGING TO THE ESTATE OF CLYDE McCONNELL HARPER LOCATED
EAST OF THOMPSON ROAD AND SOUTH OF INTERSTATE 10; DIRECTING
THE PREPARATION OF A SERVICE PLAN; AUTHORIZING AND DIRECTING
THE CITY CLERK TO PUBLISH NOTICE OF SUCH PUBLIC HEARINGS; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: On the 27th day of June, 1996, at 6:31 o'clock p.m. and at 6:35 o'clock p.m.,
in the City Council Chambers of the City Hall of Baytown, Texas, the City Council will hold public
hearings giving all interested parties the right to appear and be heard on the proposed annexation by
the City of Baytown, Texas, of the property described in Exhibit "A" which is attached hereto and
made a part hereof for all intents and purposes.
Section 2: In compliance with Texas Local Government Code Annotated § 43.056, as
amended, the Planning Department is hereby directed to prepare a service plan that provides for the
extension of municipal service into the area described in Exhibit "A."
Section 3: The City Clerk of the City of Baytown is hereby authorized and directed to
cause notice of each public hearing to be published once in the newspaper having general circulation
in the City and in the above described territory not more than twenty (20) days nor less than ten (10)
days prior to the date of each public hearing, all in accordance with Texas Local Government Code
Annotated § 43.052.
Section 4: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown this the 13th day of June, 1996.

Being a 9.8099 acre tract or parcel of land situated in the WH, HILBUS
SURVEY, Abstract No.. 336, Harris County, Texas, being out of Block One
(1), Unit "D ", of Elena Fruit and Cotton Farms, a subdivision in Harris
County, Texas, according to the flap or Plat thereof recorded in Volume
• 7 at Pages 48 and 49 of the Hap Records of Harris County, Texas, said
Block Oue (1) being the same land conveyed by General Warranty Deed dated
January 16, 1935, to Clyde H, Harper and recorded in Volume 1001, Page
814 of the Deed Recordo of Harris County, Texas, said 9.8099 acre tract
herein described being more particularly described by metes and bounds
as follows:
COMMENCING at a 1/2" iron rod found in the East right -of -way line of Thompoon
Road at the Southwest corner of said'Block One (1), Unit "D ", of Elena
Fruit and Cotton Farms;
THENCE North 88° 49' 47" East, with the South line of said Block One (1),
Unit "D", of Elena Fruit and Cotton Farms, a distance of 1183.46 feet
to a 1/2" iron rod set in the Easterly•most line of the San Jacinto River
Authority Canal right -of -way (120 feet wide), unill canal right -of -way
being originally described by field notes on a plat by A. C. Stimson,
Bounty surveyor, dated December 21, 1942, for Federal Works Agency War
Public Works, Harris County War Industries Water Supply, Dccket No. Tex. 41 -564,
Parcel No. E -59E, said iron rod being the Southwest corner and POINT OF BEGINNING
of the herein described tract;
THENCE North 88° 49' 47" East, continuing with the South line of said Block
One (1), Unit "D ", of Elena Fruit and Cotton Farms and the South line of the
herein described tract, a distance of 338.43 feet to a 1/2" iron rod set
at the SoUthwes•t corner of a tract of land called 4.35061 acres now or
formerly owned by Rena Taylor, said tract called 4,35061 arses being shown
on a plat by H. Carlos Smith, Registered Public Surveyor No. 1228 dated
March 15, 1968, and is out of a tract of land known as the Rachel Taylor
tract described in Volume 1628 at Page 484 of the Deed Records of Harris
County, Texas, said iron rod being the Southeast corner of the herein
described tract from which a found 3/4" iron pipe bears South 0,60 feet
and East 0.01 feet and from which the calculated Southeast corner of said
Block One (1), Unit "D ", of Elena Fruit and Cotton Farms bears North 88'49' 47" East,
a distance of 65,12 feet;
THENCE North 00' 34' 43" West with the West line of the said Rena Taylor tract
called 4.35061 acres, as fenced and generally'regognized and with the
East line of the herein described tract, a distance of 1157.50 feet to a 1/2"
iron rod set in the Southerly most right -of -way line of Interstate Highway
No. -10 for the Northeasterly most corner of the herein described tract,
said right -of -way being described on Texas State highway Right =of -way Map
dated February 28, 1947 and revised September, 1963, and from which said
1/2" iron rod a found 3/4" iron pipe bears South 1.87 feet and East 0.02 feet;
