ORDINANCE NO. 7683
® AN ORDINANCE AWARDING THE CONTRACT FOR COMMUNITY
DEVELOPMENT REHABILITATION PROJECT NO. 96 -04 TO PALTON
CONSTRUCTION FOR THE SUM OF SEVENTEEN THOUSAND TWO
HUNDRED EIGHTY AND N01100 DOLLARS ($17,280.00); AUTHORIZING
PAYMENT THEREOF; MAKING OTHER PROVISIONS RELATED THERETO;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown's Community Development Program did advertise for bids
for Community Development Program Rehabilitation Project No. 96 -04 to be received March 18,
1996; and
WHEREAS, notice to all bidders as to the time and place, when and where the contract
would be let was published pursuant to provisions of Section 74 of the Charter of the City of
Baytown; and
WHEREAS, all bids were opened and publicly read at the Community Development Office
at 10:00 a.m., Monday, March 18, 1996, as per published notice to bidders; and
WHEREAS, D. Richard Contractors, the company who submitted the lowest bid, was given
notice of the proposed award of Community Development Rehabilitation Project No. 96 -04, being
the repair and rehabilitation of 112 E. Cleveland, Baytown, Texas, to Palton Construction, the
company who submitted the second lowest bid; and
WHEREAS, D. Richard Contractors was afforded an opportunity to appear before the City
Council of the City of Baytown to present evidence concerning the company's responsibility; and
WHEREAS, the City Council of the City of Baytown has determined that Palton
Construction is the lowest responsible bidder for Community Development Rehabilitation Project
No. 96 -04; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby accepts the bid of Palton
Construction for the sum of SEVENTEEN THOUSAND TWO HUNDRED EIGHTY AND NO /100
DOLLARS ($17,280.00) for Community Development Rehabilitation Project No. 96 -04, being the
repair and rehabilitation of 112 E. Cleveland, Baytown, and authorizes payment thereof, providing
that final payment will not be made to said contractor until completion and acceptance of the work
by the owner and the Baytown Community Development Program.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
® § 252.048, the City Manager is hereby granted general authority to approve any change order
involving a decrease or an increase in costs of Five Thousand and No/] 00 Dollars ($5,000.00) or

less, provided that the original contract price may not be increased by more than ten (10 %) percent
or decreased by more than twenty -five (25%) percent without the consent of the contractor to such
decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown this the 11th day of April, 1996.
