Ordinance No. 7,647960314 -2 ORDINANCE NO. 7647 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, PROVIDING THAT A TEN FOOT (10') UTILITY EASEMENT OUT OF THE WILLIAM SCOTT SURVEY, ABSTRACT 65, BE VACATED, ABANDONED AND CLOSED; --PROVIDING FOR THE QUITCLAIMNG-*OF'THE' CITY'S INTEREST IN SAID PROPERTY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. *********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, there is a certain dedicated utility easement out of the William Scott Survey, Abstract 65, Harris County, Texas, said easement being located on a 5.46 acre tract between East Lobit Avenue and East James Avenue; and WHEREAS, Jon C. Pfennig, Attorney at Law, on behalf of the affected property owner, Wilkenfeld Furniture Company, Inc., has made application that the ten foot (10') easement be discontinued, closed and abandoned as a dedicated utility easement; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The property to be abandoned is described as follows: A ten foot (10') utility easement out of the William Scott Survey, Abstract 65, Harris County, Texas, said easement being located on a 5.46 acre tract between East Lobit Avenue and East James Avenue, Baytown. Section 2: That the dedicated utility easement described above is hereby closed, abandoned and permanently vacated as a dedicated easement. Section 3: That the interest or interests of the City and/or the public in the above - described easement (and as shown in Exhibit "A" attached hereto) is hereby quitclaimed to the adjacent owner for and in consideration of THREE THOUSAND FOUR HUNDRED FIFTY -FOUR AND NO / 100 DOLLARS ($3,454.00). Section 4: That the Mayor and City Clerk are hereby authorized to execute such instruments, if any, necessary for such abandonment and sale. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
