Ordinance No. 7,639960222 -6 ORDINANCE NO. 7639 AN ORDINANCE AMENDING CHAPTER 13 "FOOD AND FOOD ® ESTABLISHMENTS," ARTICLE II "PERMITS," SECTION 13 -12 "APPLICATION" OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS; AMENDING CHAPTER 28 "SWIMMING POOLS," ARTICLE II "WATER QUALITY REQUIREMENTS FOR PUBLIC SWIMMING POOLS," SECTION 28 -5 "PUBLIC SWIMMING POOL LICENSE REQUIRED," SUBSECTION (A) OF THE CODE OF ORDINANCES, CITY OF BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 13 "Food and Food Establishments," Article II "Permits," Section 13 -12 "Application" of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: ARTICLE 11. PERMITS Sec. 13 -12. Application. Any person desiring to operate a food service establishment shall make written application for a permit on forms provided by the department of health. Such application shall include, but not be limited to: the applicant's full name, post office address and street address; whether such applicant is an individual, firm or corporation, and, if a partnership, the name of each partner, and his address; the location and type of the proposed food service establishment; the signature of the applicant or applicants; and all other information deemed necessary by the director of the department of health. If the application is for a temporary food service establishment, it shall also include the inclusive dates of the proposed operation. Section 2: That Chapter 28 "Swimming Pools," Article II "Water Quality Requirements for Public Swimming Pools," Section 28 -5 "Public swimming pool license required," Subsection (a) of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: ARTICLE II. WATER QUALITY REQUIREMENTS FOR PUBLIC SWIMMING POOLS. Sec. 28 -5. Public swimming pool license required. (a) It shall be unlawful to establish, maintain or operate a public swimming pool, as herein defined, without first securing a public swimming pool license from the City of Baytown Health Department. Written application for such license must be filed with the health department, and include, but not be limited to, sufficient information as determined is by the director of the department of health to identify the owners and/or operators of the 960222 -6a public swimming pool; the location of such pool; the name and address of the person, firm or corporation seeking the license; and all other information deemed necessary by the director of the department of health. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
