Ordinance No. 7,622960208 -2 ORDINANCE NO. 7622 ® AN ORDINANCE AMENDING CHAPTER 31 "UTILITIES, "ARTICLE IV "WATER SERVICE," BY AMENDING SECTION 31 -56 "WATER RATES," SUBSECTION (f) "SERVICE FOR PROPERTY OUTSIDE THE CITY," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS; AMENDING CHAPTER 31 "UTILITIES," ARTICLE V "SEWER SERVICE," SECTION 31 -65.1 "SEWER SERVICE CHARGE FOR USERS WITHOUT WATER OR OUTSIDE CITY," SUBSECTION (B)(1) "USERS OUTSIDE THE CITY LIMITS" OF THE CODE OF ORDINANCES, CITY OF BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. is BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 31 "Utilities," Article IV "Water Service," is hereby amended by adding Section 31 -56.1 "Water service charge for users outside city," to the Code of Ordinances, City of Baytown, Texas, to read as follows: ARTICLE IV. WATER SERVICE Sec. 31 -56 Water Rates. (f) Service for property outside the city. (1) Capital charge. Upon the approval by the director of public works of an application for water service outside the city limits, persons shall pay a one- time capital charge equal to four hundred two dollars and fifty cents ($402.50) per residential connection or any other amount as may be otherwise established and approved in writing by the city council pursuant to a water supply agreement, to reimburse the city for capital investment in water lines and plant construction in addition to any monthly water service charge. (2) Monthly service charges. Persons outside the city limits and authorized by the director of public works to receive water service from the city shall pay a monthly water service charge equal to the city's minimum charge plus seven dollars and fifty cents ($7.50) and one and one -half (1%) time the rate for any additional usage charged to a user situated within the corporate limits of the City of Baytown or any other amount as may be otherwise established and approved in writing by the city council pursuant to a water supply agreement. 960208 -2a Section 2: That Chapter 31 "Utilities," Article V "Sewer Service," Section 31 -65.1 "Sewer is service charge for users without water or outside city," subsection (13)(1) "Users outside the city limits," of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: n U ARTICLE V. SEWER SERVICE. Sec. 31 -65.1. Sewer service chase for users without water or outside city. (B) Users outside the city limits. (1) Capital charge. Upon the approval by the director of public works of an application for sewer service outside the city limits, persons receiving sewer service from the city shall pay a one -time capital charge equal to five hundred twenty -five dollars ($525.00) per residential connection or any other amount as may be otherwise established and approved in writing by the city council pursuant to a waste disposal agreement, to reimburse the city for capital investment in trunk sewer and plant construction in addition to any monthly sewer service charge. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
