ORDINANCE NO. 7582
® AN ORDINANCE AUTHORIZING AND APPROVING THE EXPENDITURE
OF FUNDS IN THE AMOUNT OF FIFTY THOUSAND AND N01100
DOLLARS ($50,000.00), AND OTHER CONSIDERATIONS, FOR THE
PURCHASE OF PROPERTY IN THE LANDING AT CEDAR BAYOU,
BAYTOWN, FOR A LIFT STATION SITE; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown purchased easements from Norman
Dykes in February 1994, for sewer lines and for construction of a
lift station in the Landing at Cedar Bayou approximately 270 feet
from Highway 146; and
WHEREAS, the City has determined that a site in the Landing at
Cedar Bayou approximately 60 feet from Highway 146 is a more
advantageous location for the lift station; and
WHEREAS, Mr. Dykes is agreeable to selling the preferred
location to the City for the amount of FIFTY THOUSAND AND N01100
DOLLARS ($50,000.00) and the return of the previously purchased
easements; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: The City Council of the City of Baytown, Texas,
hereby authorizes and approves the expenditure of funds in the
amount of FIFTY THOUSAND AND NO 1100 DOLLARS ($50,000.00) for the
purchase of property in the Landing at Cedar Bayou, Baytown, for a
Lift Station Site, as set forth on Exhibit "A" attached hereto and
made a part hereof by reference for all purposes.
Section 2: That the City Council of the City of Baytown
hereby authorizes that the original easements purchased for sewer
lines and the lift station, as set forth on Exhibit "B" attached
hereto and incorporated herein, will be deeded back to Mr. Dykes as
part of the considerations for selling of the preferred location to
the City.
Section 3: This ordinance shall take effect immediately from
and after its passage by the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 14th day of December,
1995.

DESCRIPTION
Of that certain 0.0367 acre tract of land in the Jacob Armstrong
Survey, Abstract No. 2, Chambers County, Texas and out of the
49.149 acre tract described and recorded in Volume 35, Page 77 of
the Official Public Records, Chambers County, Texas, said 49.149
acres being held by Texas Trust Savings clank, Receiver for
Ranchers Savings Association and being more particularly
described as Follows:
BEGINNING at a found 1 -1/2 inch galvanized iron pipe for the
intersection of the westerly right -of -way line of Texas State
Ilighway 146 (120.00 feet wide) and the northerly right -of -way
line of Cedar Landing Drive (100.00 feet wide) as shown on the
plat of the "Landing at Cedar Bayou" as recorded in volume "B ",
Page 88 of the Plat Records of Chambers County, Texas, said 1 -1/2
inch galvanized iron pipe also being the southeast corner of the
herein described tract;
THENCE North 81 deg. 08 min, 31 sec. west, along the north right -
of -way line of Cedar Landing Drive, a distance of 40.00 feet to a
5/8 inch iron rod set for the southwest corner of this described
tract;
THENCE North 08 deg. 51 min. 23 sec. East, a distance of 40.00
feet to a 5/8 inch iron rod set for the northwest corner of the
herein described tract;
THENCE South 81 deg. 08 min. 31 sec. East, a distance of 40,00
feet to a 5/8 inch iron rod set in the westerly right -of -way of
Iiighway 146 for the northeast corner of the herein described
tract;
THENCE in a southerly direction with said westerly right -of -way,
a curve to the left having a Radius of 11,519.19 feet, a Central
Angle of 00 deg. 11 min. 56 sec., a distance of 40.00 feet to the
PLACE OF BEGINNING and containing 0.0367 acres (1600 square feet)
of land.
There is also a 20.00 feet wide strip of land adjacent and
parallel to the above described westerly and northerly lines
granted for a temporary working area and contains 0.0459 acres
(2000 square feet) of land.
