Ordinance No. 7,427950928 -15 ORDINANCE NO. 7427 AN ORDINANCE ACCEPTING THE BID OF BRANSON ELDER AND CON -TEX SERVICES, INC., FOR THE REROOFING OF THE WEST DISTRICT WASTE WATER TREATMENT PLANT CONTROL BUILDING AND EMS STATION AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE 'SUM OF THIRTY -SEVEN THOUSAND FOUR HUNDRED EIGHTY -FIVE AND N01100 DOLLARS ($37,485.00) ; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Council of the City of Baytown, Texas, did authorize the Purchasing Department for the City of Baytown to advertise for bids for the purchase of reroofing of the West District Waste Water Treatment Plant Control Building and EMS Station to be received September 13, 1995; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published pursuant to the provisions of Section 74 of the Charter of the City of Baytown; and WHEREAS, all bids were opened and publicly read at City Hall at 2:00 p.m., Wednesday, September 13, 1995, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Branson Elder for Item #1 for the reroofing of the West District Waste Water Treatment Plant Control Building and EMS Station for the sum of TWENTY -ONE THOUSAND FOUR HUNDRED FORTY -FOUR AND NO 1100 DOLLARS ($21,444.00), and authorizes payment thereof. Section 2: That the City Council of the City of Baytown hereby accepts the bid of Con -Texas Services, Inc., for Item #2 for the reroofing of the West District waste Water Treatment Plant and EMS Station for the sum of SIXTEEN THOUSAND FORTY -ONE AND N01100 DOLLARS ($16,041.00), and authorizes payment thereof. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated § 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N01100 DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty -five (250) or decreased by more than twenty -five (25 1160 percent without the consent of the contractor to such decrease.
