Ordinance No. 7,350950713 -10 ORDINANCE NO. 7350 4 40 AN ORDINANCE ACCEPTING THE BID OF M. E. TAYLOR FOR THE SALE OF SEIZED AND ABANDONED TRUCK TRACTORS AND TRAILERS IN THE AMOUNT OF ONE HUNDRED FIFTY -EIGHT THOUSAND SIX HUNDRED SEVENTY AND N01100 DOLLARS ($158,670.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Council of the City of Baytown, Texas, did authorize the Purchasing Department for the City of Baytown to advertise for bids for the sale of seized and abandoned truck tractors and trailers to be received June 27, 1995; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published pursuant to the provisions of Section 74 of the Charter of the City of Baytown; and WHEREAS, all bids were opened and publicly read at City Hall at 2:00 p.m., Tuesday, June 27, 1995, as per published notice to bidders; and WHEREAS, the truck tractors and trailers included in this bid were seized by Federal Authorities and have been stored by M. E. Taylor since 1990; and WHEREAS, the City herein agrees to accept the invoice for maintenance and storage fees submitted by M. E. Taylor as its bid; and WHEREAS, the amount bid for the purchase of the truck tractors and trailers shall be applied and shall fully satisfy the costs incurred by M. E. Taylor for the storage of the same; and WHEREAS, the City shall accept a receipt for the maintenance and storage fees which is marked "paid" from M. E. Taylor in lieu of payment for the purchase of the vehicles mentioned herein; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the findings contained in the preamble hereof are declared to be true and correct. Section 2: That the City Council of the City of Baytown hereby accepts the bid of M. E. Taylor for the sale of seized and abandoned truck tractors and trailers in the amount of ONE HUNDRED FIFTY -EIGHT THOUSAND SIX HUNDRED SEVENTY AND N01100 DOLLARS ($158,670.00). 950713 -10a Section 3: That pursuant to the provisions of Texas Local Government Code Annotated § 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N01100 DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty -five (25 %) or decreased by more than twenty -five (250) percent without the consent of the-contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
