ORDINANCE NO. 7333
• AN ORDINANCE AUTHORIZING THE PAYMENT OF TWO HUNDRED
THIRTY -EIGHT THOUSAND FOUR HUNDRED THIRTY -NINE AND 83/100
DOLLARS ($238,439.83) TO THE INTERNAL REVENUE SERVICE AND
THIRTY -SIX THOUSAND ONE HUNDRED FIFTY -FIVE AND 16/100
($36,155.16) TO C.L. WINTER, INC., AND BUTLER & BINION,
L.L.P., AS THE COST FOR PAYMENT OF THE JUDGMENT IN THE
SUIT STYLED C.L. WINTER, INC. v. CITY OF BAYTOWN, CAUSE
NO. 92- 13986, IN THE 234TH JUDICIAL DISTRICT COURT;
MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown hereby
authorizes the payment of TWO HUNDRED THIRTY -EIGHT THOUSAND FOUR
HUNDRED THIRTY -NINE AND 83/100 DOLLARS ($238,439.83) to Internal
Revenue Service for payment of the judgment in the suit styled C.L.
Winter, Inc. v. City of Baytown, Cause No. 92- 13986, in the 234th
Judicial District Court.
Section 2: That the City Council of the City of Baytown hereby
authorizes the payment of THIRTY -SIX THOUSAND ONE HUNDRED
• FIFTY -FIVE AND 16/100 DOLLARS ($36,155.16) to C.L. Winter, Inc.,
and Butler & Binion, L.L.P., for payment of the judgment in the
suit styled C.L. Winter, Inc. v. City of Baytown, Cause No.
92- 13986, in the 234th Judicial District Court.
Section 3: That pursuant to the provisions of Texas Local
Government Code Annotated § 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND N01100
DOLLARS ($15,000.00) or less, subject to the provision that the
original contract price may not be increased by more than
twenty -five (25 %) or decreased by more than twenty -five (25 %)
percent without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from
and after its passage by the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
