Ordinance No. 7,311950523 -1 ORDINANCE NO. 7311 • AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 2 "ADMINISTRATION," ARTICLE II "BOARDS AND COMMISSIONS" BY ADDING DIVISION 4.5 "ZONING COMMISSION," SECTION 2 -57 "COMMISSION -- CREATION, MEMBERSHIP, APPOINTMENT" AND DIVISION 4.5 "ZONING COMMISSION," SECTION 2 -58 "POWERS AND DUTIES" TO THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 2 "Administration," Article II "Boards and Commissions" of the Code of Ordinances of the City of Baytown, Texas, is hereby amended by adding the Division 4.5 "Zoning Commission," Section 2 -57 "Commission -- Creation, Membership, Appointment" to read as follows: Article II. Boards and Commissions. Division 4.5. Zoning Commission Sec. 2 -57. Commission -- Creation, Membership, Appointment. An agency of the City Council is hereby created which shall be known as the Baytown Zoning Commission, and such commission shall consist of the nine {9} members who serve on the Baytown Growth Management and Development Advisory Commission, the successor to the previously existing planning commission. The appointment and attendance requirements of the members, as well as the rules of procedure promulgated by the City Council for the Growth Management and Development Advisory Commission shall apply to the Zoning Commission. Section 2: That Chapter 2 "Administration," Article II "Boards and Commissions" of the Code of Ordinances of the City of • Baytown, Texas, is hereby amended by adding the Division 4.5 "Zoning Commission," Section 2 -58 "Powers and Duties" to read as follows: 950523 -1a Article II. Boards and Commissions. Division 4.5. Zoning Commission Sec. 2 -58. Powers and Duties. The Baytown Zoning Commission shall exercise the powers and shall be required to: (1) Recommend boundaries for the original zoning districts and appropriate zoning regulations for each district; (2) Make a preliminary report concerning the recommended boundaries and appropriate zoning regulations for each district; (3) Hold public hearings on the preliminary report; (4) Make a final report and submit such report to the City Council; and 5) Perform such other functions as may be duly delegated to them by the City Council. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. • 2 0 • Section 5: from and after Baytown.
