ORDINANCE NO. 7294
• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
ADDING CERTAIN PROPERTY TO COUNCIL DISTRICT NO. 4;
REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A
SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND
EFFECTIVE DATE THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown
provides that the City Council shall redistrict the City if the
growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed
territory described herein in a Council District; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: Council District No. 4 is hereby redistricted by
the addition of certain property which is described on the attached
Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent
with the terms of this ordinance are hereby repealed; provided
however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection,
paragraph, sentence, clause or phrase of this ordinance or the
application of same to any person or set of circumstances, shall
for any reason be held unconstitutional, void or invalid, such
invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other persons
or sets of circumstances and to this end all provisions of this
ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten
(10) days from its passage by the City Council. The City Clerk is
hereby directed to give notice hereof by causing the caption of
this ordinance to be published in the official newspaper of the
City of Baytown at least twice within ten (10) days after passage
of this ordinance.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown this the 27th day of April,
1995.

FIELD NOTES of a 13.9511 acre tract of land situated in the Ed. T.
Schaffer (W. C. & R. R.) Survey, Abstract No. 1224, Harris County,
Texas, being out of and a part of Lots 11 and 12 of Block 21 of
Highland Farms Addition as per plat recorded in Volume 7 at Page 60
and 61 of the Map Records of Harris County, Texas, also being out
of and a part of Lots 22 through 26 of Block 7 of the East End
Addition to Highland- Farms as per plat recorded in Volume 15 at
Page 60 of the Map Records of Harris County, Texas, also being out
of and a part of a 63.1918 acre tract of land conveyed to James W.
Gustafson by John E. Fenton, and wife, Ravynel Fenton, by deed
dated July 31, 1969, and recorded in Volume 7721 at Page 144 of the
Deed Records of Harris County, Texas, and being out of and a part
of an 18.000 acre tract of land surveyed in August of 1994 for MCW
Development Corporation. This 13.9511 acre tract of land is more
particularly described by metes and bounds as follows, to -wit:
NOTE: ALL BEARINGS ARE BASED ON A 1 AND 1/4 INCH IRON PIPE FOUND
FOR THE NORTHEAST CORNER OF SAID 63.1918 ACRE TRACT AND A 1/2 INCH
IRON PIPE FOUND FOR THE MOST EASTERLY SOUTHEAST CORNER OF SAID
63.1918 ACRE TRACT.
COMMENCING at a 1 and 1/4 inch iron pipe found for the Northeast
corner of said 63.1918 acre tract of land at the intersection of
the South right of way line of SOUTH Road, 60 foot right of way,
and the West right of way line of WEST Road, 60 foot right of way.
THENCE South 09 deg 55 min 55 sec East with the East line of said
63.1918 acre tract and the West right of way line of WEST Road a
distance of 1610.73 feet to a 1/2 inch iron rod found for the most
Eastern Northeast corner of this tract of land, the most Eastern
Northeast corner of said 18.000 acre tract and the POINT OF
BEGINNING.
THENCE South 09 deg 55 min 55 sec East with the East line of this
tract, the East line of said 18.000 acre tract, the East line of
said 63.1918 acres and the West right of way line of WEST Road a
distance of 56.54 feet to a 1/2 inch iron rod found for the most
Eastern Southeast corner of this tract of land and the most Eastern
Southeast corner of said 18.000 acre tract. From this corner a 1/2
inch iron pipe found for the most Easterly Southeast corner of said
63.1918 acre tract bears South 09 deg. 55 min. 55 sec. East a
distance of 332.42 feet.
THENCE North 82 deg 00 min 00 sec West with the South line of this
tract of land and the South line of said 18.000 acre tract a
distance of 26.63 feet to a 1/2 inch iron rod found for a corner of
this tract of land, a corner of said 18.000 acre tract and in the
North line of a 30 foot pipeline easement being the same easement
• conveyed to United Gas Pipeline Company by J. E. Fenton by
instrument dated August 21, 1951, and recorded in Volume 2335 at
Page 48 of the Deed Records of Harris County, Texas.

THENCE South 80 deg 01 min 00 sec West with the South line of this
tract of land, the South line of said 18.000 acre tract and the
North line of said easement a distance of 489.92 feet to a 1/2 inch
iron rod found for a corner of this tract, a corner of said 18.000
acre tract and a corner of said easement.
THENCE South 53 deg 31 min 15 sec West with the Southeast line of
this tract, the Southeast line of said 18.000 acre tract and the
Northwest line of said easement a distance of 480.13 feet to a 1/2
inch iron rod found for a corner of this tract of land and a corner
of said 18.000 acre tract.
THENCE South 13 deg 21 min 43 sec West with the East line of this
tract of land and the East line of said 18.000 acre tract a
distance of 101.32 feet to a 1/2 inch iron rod found for the most
Southern Southeast corner of this tract of land, the most Southern
Southeast corner of said 18.000 acre tract and in the North right
of way line of Lynchburg -Cedar Bayou Road, 100 foot right of way.
From this corner a 1/2 inch iron rod found for a point of curve in
the North right of way line of Lynchburg -Cedar Bayou Road bears
South 76 deg. 38 min. 17 sec. East a distance of 201.48 feet.
THENCE North 76 deg 38 min 17 sec West with the South line of this
tract, the South line of said 18.000 acre tract and the North right
of way line of the Lynchburg -Cedar Bayou Road a distance of 158.97
feet to a point for the most Southern Southwest corner of this
tract of land. This point is situated in the East line of the City
of Baytown city limits.
THENCE in a Northerly direction with the West line of this tract,
the East line of the City of Baytown city limits, parallel with and
a radial distance of 300 feet Easterly of the centerline of Garth
Road (120 foot wide right of way) , a curve to the left, concave
West, having a central angle of 07 deg 33 min 02 sec, a radius of
2693.83 feet, a length of 354.99 feet and a chord bearing and
distance of North 05 deg 29 min 15 sec West 354.74 feet to a point
for a corner of this tract, a corner of said East line of the City
of Baytown city limits and the point of tangency of said curve.
THENCE North 09 deg 15 min 46 sec West, parallel with and 300 feet
Easterly of the centerline of Garth Road, with the West line of
this tract of land and the East line of the City of Baytown city
limits a distance of 488.88 feet to a point for the Northwest
corner of this tract of land and in the Northwest line of said
18.000 acre tract.
THENCE North 53 deg 31 min 15 sec East with the Northwest line of
this tract of land and the Northwest line of said 18.000 acre tract
a distance of 521.98 feet to a 1/2 inch iron rod found for the
• North corner of this tract of land and the North corner of said

to a 1/2 inch iron rod found for an interior corner of this tract

to a 1/2 inch iron rod found for a corner of this tract of land and

said boundaries 13.9511 acres of land.
