ORDINANCE NO. 7226
• AN ORDINANCE AUTHORIZING CHANGE ORDER NO. 3 WITH N & S
CONSTRUCTION CO., INC., FOR THE EAST DISTRICT WASTEWATER
TREATMENT PLANT EXPANSION; AUTHORIZING PAYMENT BY THE
CITY OF BAYTOWN, THE SUM OF TWO THOUSAND THREE HUNDRED
THIRTY -SEVEN AND N01100 DOLLARS ($2,337.00); MAKING OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council does hereby authorize Change
Order No. 3 with N & S Construction Co., Inc., for the East
District Wastewater Treatment Plant Expansion. A copy of said
change order is attached hereto, marked Exhibit "A," and made a
part hereof for all intents and purposes.
Section 2: That the City Council of the City of Baytown hereby
authorizes the payment of TWO THOUSAND THREE HUNDRED THIRTY -SEVEN
AND N01100 DOLLARS ($2,337.00) to N & S Construction Co., Inc., for
Change Order No. 3 for the East District Wastewater Treatment Plant
Expansion.
Section 3: That pursuant to the provisions of Texas Local
Government Code Annotated § 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND N01100
DOLLARS ($15,000.00) or less, subject to the provision that the
original contract price may not be increased by more than
twenty -five (250) or decreased by more than twenty -five (25 %)
percent without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from
and after its passage by the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown this the 9th day of February,
1995.

CONTRACTOR: Nunn & Shumway Construction Company, Inc., d/b /a
N & S Construction Co., Inc.
CONTRACT DATED: March 8, 1994
ORIGINAL CONTRACT AMOUNT: $3,704,613.50
PROJECT: East District S.T.P. Expansion, 1.5 MGD
WSA JOB NO.: 024 -013 -4
Honorable Mayor & City Council:
The City has requested the Contractor to add several items to the construction
contract as follows:
1. Relocate the drain line DR -10 in order to avoid a large buried concrete structure
which was unknown prior to plant construction. The cost for this work is $575.00.
2. Replace a 6 -inch existing sludge line, with approximately 80 lineal feet of C -900
PVC plus necessary fittings. The existing line, exposed by construction, is in very
bad condition and poses a continuous maintenance problem. The cost for this
work is $1,762.00.
The total cost will be $2,337.00. A copy of the Contractor's proposal is included
herewith.
