ORDINANCE NO. 7193
AN ORDINANCE AMENDING ORDINANCE NO. 6909 RELATING TO
REGULATIONS FOR CABLE RATES FOR BASIC SERVICE TIER,
CLARIFYING WHEN OPERATOR CAN APPLY FOR FIRST ANNUAL
INFLATION ADJUSTMENT; AND PROVIDING FOR AN EFFECTIVE DATE
THEREOF.
WHEREAS, on January 27, 1994, Council passed Ordinance No.
6909, which enacted local regulations for rates charged cable
television subscribers for the basic service tier consistent with
those established by the Federal Communications Commission; and
WHEREAS, the Federal Communications Commission since such time
has adopted revised regulations; and
WHEREAS, the local cable regulations as originally enacted
restricted the cable operator from adjusting rates for inflation
until one year after the initial rate determination; and
WHEREAS, the revised FCC regulations now clarify the first
annual inflation adjustment can be made after September 30, 1994;
NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1. That Ordinance No. 6909 at section 4 "Review of
Request for Increase in Basic Cable Rates," Subsection A "Notice"
is hereby amended to hereafter read as follows:
A. Notice. A cable operator in the City who wishes to
increase the rates for the basic service tier or
associated equipment shall file a request with the City
and notify all subscribers at least thirty (30) days
before the cable operator desires the increase to take
effect. This notice may not be given more often than
annually if the adjustment is based on charges in the
Gross National Product Price Index. The first annual
inflation adjustment may be made after September 30, 1994
and all annual inflation adjustment must be made in
accordance with FCC guidelines and regulations
• Section 2: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
