ORDINANCE NO. 7150
• AN ORDINANCE RENEWING THE CONTRACT OF DEER PARK LUMBER
COMPANY AND THE GLIDDEN COMPANY FOR THE ANNUAL
CONSTRUCTION MATERIALS (MASONRY, LUMBER, AND PAINT)
CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN,
THE SUM OF EIGHTY THOUSAND FOUR HUNDRED NINE AND 69/100
DOLLARS ($80,409.69) MAKING OTHER PROVISIONS RELATED
THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, Deer Park Lumber Company and The Glidden Company were
awarded the annual construction materials (masonry, lumber, and
paint) contract on December 13, 1993, pursuant to competitive
bidding procedures, which contract included an option by the
parties to renew for two (2) additional one (1) year periods; and
WHEREAS, Deer Park Lumber Company and The Glidden Company have
indicated their willingness to renew the contract for an additional
year under the same terms and conditions; and
WHEREAS, the Administration has reviewed the market conditions
and recommends renewal as being in the best interest of the City;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown
hereby renews the contract of Deer Park Lumber Company for Sections
I, II, IV, and V of the annual construction materials (masonry,
lumber, and paint) contract for the sum of SEVENTY -ONE THOUSAND
FIVE HUNDRED THIRTY -FIVE AND 19/100 DOLLARS ($71,535.19) and
authorizes payment thereof.
Section 2: That the City Council of the City of Baytown
hereby renews the contract of The Glidden Company for Section III
of the annual construction materials (masonry, lumber, and paint)
contract for the sum of EIGHT THOUSAND EIGHT HUNDRED SEVENTY -FOUR
AND 50/100 DOLLARS ($8,874.50) and authorizes payment thereof.
Section 3: That pursuant to the provisions of Texas Local
Government Code Annotated S 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND NO 1100
DOLLARS ($15,000.00) or less, provided that the original contract
price may not be increased by more than twenty -five (25 %) percent
or decreased by more than twenty -five (25 %) percent without the
consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from
Sand after its passage by the City Council of the City of Baytown.
