• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
ADDING CERTAIN PROPERTY TO COUNCIL DISTRICT NO. 3;
REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A
SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND
EFFECTIVE DATE THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown
provides that the City Council shall redistrict the City if the
growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed
territory described herein in a Council District; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: Council District No. 3 is hereby redistricted by
the addition of certain property which is described on the attached
Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent
with the terms of this ordinance are hereby repealed; provided
however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection,
paragraph, sentence, clause'or phrase of this ordinance or the
application of same to any person or set of circumstances, shall
for any reason be held unconstitutional, void or invalid, such
invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other persons
or sets of circumstances and to this end all provisions of this
ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten
(10) days from its passage by the City Council. The City Clerk is
hereby directed to give notice hereof by causing the caption of
this ordinance to be published in the official newspaper of the
City of Baytown at least twice within ten (10) days after passage
of this ordinance.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown this the 13th day of October,
1994.

Being a 5.558 acre tract or parcel of land situated in the WILLIAM
HILBUS SURVEY, Abstract No. 336, Harris County, Texas, being out of
Block One (1), Unit "D". of Elena Fruit and Cotton Farms. a subdivision
in Harris County. Texas, according to the Map or Plat thereof recorded
in Volume 1 at Pages 48 and 49 of the Map Records of Harris County,
Texas, said Block One (1) being the same land conveyed by General
Warranty Deed dated January 16, 1935, to Clyde M. Harper and recorded
in Volume 1001, Page 814 of the Deed Records of Barris County. Texas,
said 5.558 acre tract or parcel of land herein described being more
particularly described by mates and bounds as follows:
COMMENCING at the South right-of-way line of Ellis School Road (60
feet vide) at its intersection with the East right-of-way line of
Thompson Road. said intersection being the original Northwest corner
of said Block One (1), Unit "D ", of Elena Fruit and Cotton Farms,
from which a found 5/8" iron rod bears North 0.77 feet and east 0.35
feet, said point also bears North 00' 40' 00" best a distance of 673.45
feet from the Easterly most right-of-way line of Thompson Road at its
intersection with the Northerly most right-of-way line of Interstate
Highway No. 10;
THENCE North 88' 44' 00" East with the South right- of-way line of
Ellis School Road and the North boundary line of said Block One (1).
Unit "D ", of Elena Fruit and Cotton Farms, a distance of 283.68 feet
to a 518" iron rod set for the Northwesterly most corner of the herein
described tract and POINT OF BEGINNING;
THENCE North 88' 44' 00" East continuing with the South right- of-way
line of Ellis School Road and the North boundary line of said Block One
(1). Unit "D ", of Elena Fruit and Cotton Farms, a distance of 604.04 feet
to a 112" iron rod not for the Northeast corner of the herein described
tract. said iron rod being also situated in the South right-of -way line
of Ellis School Road at its intersection with the Westerly most line
of the San Jacinto River Authority Canal right-of-way (120 feet wide),
said canal right-of-way being originally described by field notes on
a plat by A. C. Stimson. County Surveyor, dated December 21. 1942, for
Federal Works Agency War Public Works, Harris County War Industries
Water Supply, Docket No. Tax. 41 -564. Parcel No. E -59E;
THENCE South 06' 50' 16" East with the Westerly most line of the said
San Jacinto River Authority Canal right-of-way (120 feet wide) as
established on the ground and with the full knowledge of the San
Jacinto River Authority Canal Right-of-way Department, a distance
of 369.30 feat to a 1/2" iron rod set for the Southeasterly most
corner of the herein described tract, said iron rod being situated
in the Northerly most right-of-way line of Interstate Highway No. 10,
described on Texas State Highway Department Right-of-way Map dated
February 28. 1947, and revised September, 1963;
THENCE South 66' 46' 30" West with the Northerly most right- of-way
line of Interstate Highway No. 10 and the Southerly most line of
the herein described tract. a distance of 349.30 feet to a point
marking a corner of the herein described tract and a point of
intersection in the Northerly most right-of-way line of Interstate
Highway No. 10, from which a found concrete highway right -of -way
monument bears East a distance of 0.43 feet;

THENCE South 81' 46' 30" West, continuing with the Northerly most right -of-
way line of Interstate Highway No. 10 and the Southerly most line of the
herein described tract, a distance of 69.50 feet to a point marking a
corner of the herein described tract and a point of intersection in the
Northerly most right- of-way line of Interstate Highway No. 10, from which
a found concrete highway right - of-way monument bears South a distance of
0.01 feet and East a distance of 0.39 feet;
THENCE South 66` 46' 30" West, continuing with the Northerly most right -
of-way line of Interstate Highway No. 10 and the Southerly most line of the
herein described tract, a distance of 40.04 feet to a 1/2" iron rod set
for the Southwesterly most corner of the herein described tract;
THENCE North 23' 10' 48" West with the Easterly most line of a 3.7689
acre tract of land previously conveyed to Mapco Petroleum, Inc. out of
said Block One (1). Unit "D ", of Elena Fruit and Cotton Farms, a distance
of 562.18 feet to the POINT OF BEGINNING, containing 242.104.10 square
feet or 5.558 acres of land.
