Ordinance No. 7,081940829 -1 ORDINANCE NO. 7081 AN ORDINANCE AUTHORIZING THE U.S. DEPARTMENT OF DEFENSE -JOINT TASK FORCE -6 TO CONSTRUCT IMPROVEMENTS AT THE CITY OF BAYTOWN POLICE DEPARTMENT FIREARMS RANGE; AUTHORIZING PAYMENT UP TO THE AMOUNT OF FIFTY THOUSAND AND N01100 DOLLARS ($50,000.00) FROM FORFEITED FUNDS FOR BUILDING MATERIALS RELATED TO THE IMPROVEMENTS AT THE FIREARMS RANGE; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown Police Department maintains a firearms training range that is in need of construction/ building improvements and upgrades; and WHEREAS, the Houston High Intensity Drug Trafficking Area, Major Drug Squads, referred to as HIDTA, has arranged for the U.S. Department of Defense -Joint Task Force -6 to provide equipment and personnel to construct improvements and upgrades to the police firearms training range; and WHEREAS, the improvements and upgrading of the police firearms training range will enhance the firearms and counter drug training of police officers and recruits attending the Baytown Police Academy; and WHEREAS, funds for the payment of costs of building materials related to the improvements and upgrades at the Baytown Police Department training range were obtained as a result of combined drug enforcement operations between the City of Baytown Police Department and federal law enforcement agencies, and which have been placed in a special City revenue account 12256; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS' 1: That the City Council of the City of Baytown, Texas, hereby authorizes the U.S. Department of Defense -Joint Task Force -6 to construct improvements and upgrades to the Baytown Police Department firearms training range during the period of September through November, 1994. Section 2: That the City of Baytown Purchasing Department is hereby authorized to make payments for the construction/ building materials needed for the project and outlined in the attached list of materials, marked Exhibit "A," in a total amount not to exceed FIFTY THOUSAND AND N01100 DOLLARS ($50,000.00) from the above - described forfeited funds. Section 3: That the construction/ building materials needed to construct the upgrades and improvements to the police firearms training range be purchased through the City of Baytown Purchasing Department annual materials contracts or standard City purchasing procedures. 940829 -1a • Section 4: That the construction equipment and personnel furnished by the U.S. Department of Defense -Joint Task Force -6 shall be under the supervision and control of military officers assigned to the unit and they will coordinate their activities with a representative of the Baytown Police Department. Section 5: That the City of Baytown shall not be responsible for the acts or omissions of personnel assigned to the U.S. Department of Defense -Joint Task Force -6 nor shall the City accept any liability or responsibility for any military personnel or equipment assigned to the construction project. Section 6: That the U.S. Department -Joint Task Force -6 shall provide funding for all personnel and equipment for this project and all funds related to transportation, equipment, billeting, and meals of military personnel, and the City of Baytown shall not be liable for any such costs. Section 7: That pursuant to the provisions of Texas Local Government Code Annotated $ 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N01100 DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty -five (25 %) or decreased by more than twenty -five (25 %) percent without the consent of the contractor to such decrease. Section 8: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
