Ordinance No. 7,080940825 -10 7VITIMMUNWRIEW4 Me • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING ORDINANCE NO. 6019 TO AMEND THE ASSESSMENT ROLL FOR THE ROLLINGBROOK /BAKER CONNECTION BOULEVARD; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on October 10, 1991, the City Council of the City of Baytown passed Ordinance No. 6019, which provided for the assessment of property owners adjoining the improvements to the Rollingbrook /Baker Connection Boulevard; and WHEREAS, Emmett 0. Hutto, Trustee, was shown on the assessment roll as owner of a 6.5+ acre tract identified as Parcel 14; and WHEREAS, in March 1993, the Harris County Appraisal District corrected the tax roll to reflect Emmett O. Hutto, Trustee, as owner of 3.2846 acres, with the Harris County Flood Control owning the remainder of the tract; and WHEREAS, the Assessment Roll has been revised to reflect the change in acreage owned by Emmett 0. Hutto, Trustee; and WHEREAS, it is necessary to amend Ordinance No. 6019 to reflect the revision of the assessment roll for the Rollingbrook /Baker Connection Boulevard; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Ordinance No. 6019 is amended by the adoption of a new assessment roll for the Roll ingbrook/ Baker Connection Boulevard, with the correction being made to Parcel 14. The corrected assessment is attached hereto as Exhibit "All and made a part hereof for all intents and purposes. Section 2: The assessment for Parcel 14 as contained in Ordinance No. 6019 is hereby repealed as to the extent it is in excess of the amount shown on the attached Exhibit "A." Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. . Box 424 Baytown, Texas 77522 -0424 ATTN: Ms. Eileen Hall Dear Ms. Hall: DOROTHY GRAHAM, GRI It has come to my attention that Parcel 14 of the Rolling Brook /Baker Road connection Boulevard was assessed on the basis of being 6.5 acres or 283,140 square feet as shown in the attached letter, when according to a copy of a plat attached and a copy of the tax statement, the property was in fact only 3.2846 acres or 143,077 square feet. Based on the new figure the assessment should have been as follows; 143,077 sq. ft. X $0.25 per sq. ft. = $35,769.25 divided by 2 = $17,884.63. The total assessment for Tract 14, should have been: SEVENTEEN THOUSAND EIGHT HUNDRED EIGHTY -FOUR & 63/100 DOLLARS ($17,884.63) If I may be of further assistance in this matter, please advise.
