Ordinance No. 7,053940728 -12 ORDINANCE NO. 7053 • AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, WAIVING THE PENALTY ON THE DELINQUENT TAX ACCOUNT 1052 -134 -6 FOR TAX YEAR 1993; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Enterprise Leasing Company filed a notice of protest with the Harris County Appraisal District in a timely manner as to the value of their personal property account 1052- 134 -6; and WHEREAS, the Harris County Appraisal District supplemented the account to the City of Baytown with an incorrect mailing address; and WHEREAS, Enterprise Leasing Company did not get the tax bill prior to the delinquent date due to the incorrect mailing address provided to the City by the Harris County Appraisal District; and WHEREAS, Section 33.011 of the Texas Property Tax Code provides, in part, [t]he governing body of a taxing unit shall waive penalties ... on a delinquent tax account if an act or omission of an officer, employee, or agent of ... the appraisal district in which the taxing unit participates caused or resulted in the taxpayer's failure to pay the tax before delinquency. Tex. Tax Code Ann. S 33.011 (Vernon 1991); NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby approves the waiver of penalties for the tax year 1993 on tax account 1052 -134 -6 in the amount of ONE THOUSAND TWO HUNDRED SEVENTY -TWO AND 91/100 DOLLARS ($1,272.91). Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
