Ordinance No. 7,028940623 -9 ORDINANCE NO. 7028 • AN ORDINANCE REDUCING THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF BAYTOWN AND AUTHORIZING THE CITY OF DAYTON, TEXAS, TO ANNEX A PORTION OF THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF BAYTOWN; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown includes a certain portion along Highway 90 within its corporate boundaries; and WHEREAS, the City of Baytown thereby acquired extraterritorial jurisdiction of all unincorporated areas contiguous to its corporate boundaries to a distance of 3 1/2 miles, by virtue of Texas Local Government Code § 42.021(4); and WHEREAS, the City of Dayton wishes to annex a certain tract of land within the extraterritorial jurisdiction of the City of Baytown; and WHEREAS, the City Manager of the City of Dayton has requested that the City of Baytown relinquish its extraterritorial jurisdiction over the area which the City of Dayton wishes to annex; and WHEREAS, the City Manager of the City of Baytown has determined that the proposed annexation would not be detrimental to the best interests of the City of Baytown; and WHEREAS, Texas Local Government Code S 42.023 gives the City Council of the City of Baytown the authority to reduce the extraterritorial jurisdiction of the City of Baytown; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby consents to reduce, and does hereby reduce and relinquish the extraterritorial jurisdiction of the City of Baytown to the extent of the area described in attachment "A" hereto. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
