Ordinance No. 7,013940601 -1 ORDINANCE NO. 7013 . AN ORDINANCE AUTHORIZING CHANGE ORDER NO. 2 WITH ANGEL BROTHERS ENTERPRISES, INC. FOR THE 1993 STREET IMPROVEMENT PROGRAM - PHASE II; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF ONE HUNDRED THIRTY -EIGHT THOUSAND SIX HUNDRED EIGHTY -FIVE AND 25/100 DOLLARS ($138,685.25); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. *********************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council does hereby authorize Change Order No. 2 with Angel Brothers Enterprises, Inc. for the 1993 Street Improvement Program - Phase II. A copy of said change order is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: That the City Council of the City of Baytown hereby authorizes the payment of ONE HUNDRED THIRTY -EIGHT THOUSAND SIX HUNDRED EIGHTY -FIVE AND 25/100 DOLLARS ($138,685.25) to Angel Brothers Enterprises, Inc. for Change Order No. 2 for the 1993 Street Improvement Program - Phase II. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated S 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N01100 DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty -five (25 %) or decreased by more than twenty -five (25 %) percent without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. First, when the contractor removed the concrete base from Defee Street between Commerce and North Main the soil below was found to be in poor condition. Apparently inadequate drainage in the area had caused about 24 inches of the subgrade to become saturated and unsuitable for paving. Three solutions were considered to alleviate the situation and costs calculated for each. They were (1) pour a new concrete base to bridge the poor soil, (2) remove the soil, dry it, lime stabilize it and place it back in the excavation, and (3) remove the bad material and replace it with limestone. The last option was the median cost, but is by far the most expedient route and was therefore chosen. The cost of this procedure is estimated to be $36,109.00 This cost also includes adding two 5 ft. curb inlets and 60 feet of 15 inch RCP to provide for drainage, the lack of which caused the problem. The other two options were within $3,000.00 of this figure. This operation also eliminates 1,253 S.Y. of lime stabilization and a like amount of base reconstruction at a total savings of about $7,500.00 which will show up as underruns of those bid items. The net cost of this change will actually be about $28,609.00. Second, although most of Sterling was not to be reconstructed, the installation of the new water and sewer lines along with all the utility service lines which had to be reconnected has virtually destroyed the integrity of the existing base. Consequently it has been decided it would be best to go ahead and reconstruct the base on most of Sterling. This construction will add a net cost of $110.076.25 to the project.
