ORDINANCE NO. 6989
. AN ORDINANCE ACCEPTING THE DEDICATION OF PROPERTY BY
WALGREEN CO.; DIRECTING THE CITY CLERK TO FILE SAID
DEDICATION WITH THE COUNTY CLERK OF HARRIS COUNTY, TEXAS;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, formally accepts the dedication of certain property from
Walgreen Co., the owner of the property as described in Exhibit
"A," and made a part hereof for all intents and purposes.
Section 2: The City Clerk is hereby directed to file the
dedication deed with the County Clerk of Harris County, Texas.
Section 3: This ordinance shall take effect immediately from
and after its passage by the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown this the 28th day of April,
1994.

real property, by these presents DONATES, DEDICATES, GRANTS, and CONVEYS
unto The CITY OF BAYTOWN, a municipal corporation, of the Counties of Harris and
Chambers and the State of Texas, all of the following described real property located in
Harris County, Texas:
SEE ATTACHED EXHIBIT "A" ( "Property ")
TO HAVE AND TO HOLD the above described premises, together with all and
singular the rights and appurtenances thereto in any wise belonging, unto the said CITY
OF BAYTOWN, its successors and assigns forever.
GRANTOR agrees to bind itself to WARRANT and FOREVER DEFEND, the
Property unto the said CITY OF BAYTOWN, its successors and assigns, against every
person whomsoever, lawfully claiming or to claim the same or any part thereof, by
through or under Grantor, but not otherwise.

A parcel or tract of land containing 7,560 square feet being a portion of that
certain 30 foot wide Easement granted to the City of Baytown for the southerly
one -half of Birdsong Drive as described in Clerk's File E- 251518 (HCCOPRRP),
same being more particularly described by metes and bounds as follows:
BEGINNING at the Northwest comer of a 24.129 Acre Tract as described
in Cleric's File No. G- 888599, on the easterly right - of-way of Garth Road (80 feet
wide);
THENCE, S 89 deg. 53'35" E, along the northerly line of said 24.129
Acre Tract, for a distance of 252.00 feet to a point for corner;
THENCE, S 00 deg. 19'55" W, for a distance of 30.00 feet to a 518 -inch
iron rod set for comer, on the southerly line of the aforesaid 30 foot wide
Easement for Birdsong Drive;
THENCE, N 89 deg. 53'35" W, along the southerly line of the said 30 foot
wide Easement for Birdsong Drive, for a distance of 252.00 feet to a 5/8 -inch
iron rod set for corner, on the easterly right - of-way line of Garth Road (80 feet
wide);
