Ordinance No. 6,983• • 940414 -15 ORDINANCE NO. 6983 AN ORDINANCE AMENDING CHAPTER 27 "SUBDIVISIONS," ARTICLE III "OTHER DEVELOPMENTS," OF THE CODE OF ORDINANCES, CITY OF BAYTOWN, TEXAS, BY REPEALING SECTION 27 -35 "OTHER DEVELOPMENTS," AND ADDING SECTION 27 -35 "LARGE LOT ESTATE DEVELOPMENT" AND SECTION 27 -36 "OTHER DEVELOPMENTS "; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That,Chapter 27 "Subdivisions," Article III "Other Developments," Section 27 -35 "Other Developments," of the Code of Ordinances, City of Baytown, Texas, is hereby repealed and Section 27 -35 "Large Lot Estate Development," is hereby added to read as follows: ARTICLE III. OTHER DEVELOPMENTS. Sec. 27 -35. Large Lot Estate Development. Large lots with wide frontage result in less drainage and traffic demands than single - family residential developments consisting of small lots with narrow frontages and widths. Therefore, the facility requirements and public impacts of the larger, "estate- type" developments are less intensive. Such developments are desirable for the community to attract and encourage development and should not have to conform to the same standards which apply to the more intense developments. Residential developments undertaken pursuant to this section shall conform to the provisions outlined below and are considered exempt from conflicting provisions specified elsewhere in this chapter of the Code of Ordinances. (a) Definitions. Large Lot Residential Estate Development is defined as a subdivision in which the minimum lot size is one acre and the minimum street frontage for any lot is 60 feet with a minimum lot width of 120 feet at the building setback line. (b) Lot Standards. a. Minimum Lot Width: 120 feet to be measured at the building setback line (c) Street Standards. Streets can be constructed using either asphalt or concrete as provided herein. a. Right -of -Way The street right -of -way shall be a minimum of 60 feet b. Asphalt streets shall be constructed as described below: 1. Width: 22 feet of paved HMAC surface 2. Shoulders: 4 feet on each side paved with an asphaltic chip seal 3. The pavement and shoulders shall both have an eight inch ( 8") flexible base and a six inch (611) lime stabilized subgrade. The HMAC surface shall be one and one -half inches (1.511) thick. c. Concrete streets shall be constructed as described below: 1. Width: 22 feet of pave surface 2. Shoulders: no shoulders required on. concrete streets 3. The concrete pavement shall be a minimum six inches (611) thick with a six inch (611) lime stabilized subgrade that extends one foot (11) beyond the edge of the pavement. The concrete pavement shall be constructed in accordance with specifications for such pavement provided for in Article VII of Chapter 27 of the Code of Ordinances. The outer three feet (31) of each side of the pavement shall have the steel reinforcement paced on twelve inch (1211) centers. d. Roadside Ditches. Roadside ditches may be used for drainage if constructed as follows: F=� 940414 -15b a. Maximum side slopes: 3:1 b. Maximum depth: 5 feet measured from the crown of the finished pavement. S. Extension of Utilities. If municipal water or sewer utilities of sufficient capacity are available within 2,000 feet of the proposed site, the developer shall be required to extend the utilities to the site and make them available to every lot in the development. Section 2: That Chapter 27 "Subdivisions," Article III "Other Developments," Section 27 -36 "Other Developments," of the Code of Ordinances, City of Baytown, Texas, is hereby added to read as follows: Sec. 27 -36. Other Developments. With the rapid changes that occur in development ideas and layouts, it is impossible to write regulations to cover every conceivable development. The planning commission, upon recommendation of the Director of Planning and /or the City Engineer, is empowered to determine the specific requirements for each development that does not logically fall in an existing category. The planning commission may adjust the requirements for lot size, street construction, individual metering and sidewalks in developments that are proposed which do not fit existing categories. In approving developments under this section, the commission should determine that: (1) The proposed use is appropriate and reasonable for the area; (2) Approval will not be detrimental to public health, safety, and welfare; (3) That the effect of the development will not prevent orderly subdivision of other land in the vicinity; and (4) That the development will not cause the city to be required to provide city services at a level above that required in other subdivisions. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such 3 940414 -15c invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
