ORDINANCE NO. 6907
• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
AMENDING CHAPTER 8, "CITY CIVIL SERVICE FOR FIREMEN AND
POLICEMEN," SECTION 8 -10 "DIRECTOR OF FIREMEN'S AND
POLICEMEN'S CIVIL SERVICE -- OFFICE ESTABLISHED;
QUALIFICATIONS; REMOVAL" ESTABLISHING AN EXCEPTION,
CONSISTENT WITH SECTION 143.012 OF THE LOCAL GOVERNMENT
CODE, TO THE THREE YEAR RESIDENCY REQUIREMENT FOR THE
DIRECTOR OF FIRE FIGHTERS' AND POLICE OFFICERS' CIVIL
SERVICE; PROVIDING A REPEALING CLAUSE; CONTAINING A
SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, Section 143.012 of the Texas Local Government Code
provides an exception to the three year residency requirement for
the director of firemen's and policemen's civil service; and
WHEREAS the proposed ordinance will bring the City of Baytown
into compliance with the residency requirements of the civil
service statutes of the State of Texas; NOW THEREFORE
BE IT ORDAINED BY `THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Chapter 8, "City Civil Service for Firemen
and Policemen," Section 8 -10, "Director of Firemen's and
Policemen's Civil Service -- Office Established; Qualifications;
Removal," is hereby amended to read as follows:
Sec. 8 -10 Director of firemen's and policemen's civil service
-- Office established; qualifications; removal.
There is hereby established the office of the director
of firemen's and policemen's civil service, which shall
be filled by appointment by the commission of some
person meeting the same requirements as provided for
members of the commission; provided, however, the person
is not required to meet the three -year local residency
requirement. The director may be either a member of the
commission, another employee of the city or some other
person. The city council of the city shall determine
what salary, if any, shall be paid to such director.
The director shall at all times, be subject to removal
by the commission for cause upon written charges after
a public hearing by the commission.
Section 2: All ordinances or parts of ordinances inconsistent
with the terms of this ordinance are hereby repealed; provided
however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be
• cumulative of other ordinances regulating the governing the subject
matter covered by this ordinance.

• Section 3: If any provisions, section, exception, subsection,
paragraph, sentence, clause or phrase of this ordinance or the
application of the same to any person or set of circumstances shall
for any reason be held unconstitutional, void or invalid, such
invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other persons
or sets of circumstances and to this end all provisions of this
ordinance are declared severable.
Section 4: This ordinance shall take effect immediately from
and after its passage by the City Council.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown this the 13th day of January,
