Ordinance No. 6,825931014 -8 ORDINANCE NO. 6825 • AN ORDINANCE AUTHORIZING THE PAYMENT OF THE SUM OF THIRTEEN THOUSAND AND N01100 DOLLARS ($13,000.00) TO UNIVERSAL COMPUTER TECHNOLOGIES, INC. AS THE SOLE SOURCE FOR THE MAINTENANCE ON SOFTWARE FOR THE BAYTOWN POLICE DEPARTMENT AND MUNICIPAL COURT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Police Department and Municipal Court requires maintenance for its software; and WHEREAS, TEX.L.GOV'T.CODE ANN. $ 252.022 provides that when the functional requirements of the City can only be satisfied by one source, the requirement for competitive bids is not applicable; and WHEREAS, the procurement of the maintenance on software for the Baytown Police Department and Municipal Court can be satisfied by only one source, Universal Computer Technologies, Inc., NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that only one source can satisfy the needs of the City for the maintenance on software for the Baytown Police Department and Municipal Court. Section 2: That payment to Universal Computer Technologies, Inc., as the sole source, of THIRTEEN THOUSAND AND N01100 DOLLARS ($13,000.00), for the above - described maintenance on software is hereby authorized. Section 3: That pursuant to the provisions of TEX. L. GOV'T. CODE ANN. $ 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N01100 DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty -five (25 %) or decreased by more than twenty -five (25 %) percent without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
