Ordinance No. 6,771930909 -18 ORDINANCE NO. 6771 • A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE DEDICATION OF PROPERTIES BY USX CORPORATION; DIRECTING THE CITY CLERK TO FILE SAID DEDICATION WITH THE COUNTY CLERK OF HARRIS COUNTY, TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, formally accepts the dedication of certain properties from USX Corporation, the owner of the property as described in Exhibit "A," and the property described in Exhibit "B," made a part hereof for all intents and purposes. Section 2: The City Clerk is hereby directed to file the easements with the County Clerk of Harris County, Texas. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. AL O, Mayor T _ JAB:pfc #351 08/16/93 SANITARY SEWER EASEMENT AGREEMENT This Agreement is made this �` '7day of , 1993, between USX Corporation, a Delaware corporation, hereinafter called "Grantor" and the City of Baytown, State of Texas, hereinafter called "Grantee ". W I T N E S S E T K: For good and valuable consideration and intending to be legally bound, Grantor and Grantee agree as follows: A. Grantor hereby grants and conveys unto the Grantee three (3) non - exclusive easements for the construction and installation of sanitary sewer lines and a lift station in and to the following described properties owned by Grantor and situate in the John Steele Survey A -227, Chambers County, Texas, as shown generally on the attached Plat of Three Easements, marked Exhibit A and made a part hereof: 1. A non - exclusive easement in and to a fifteen (15) foot wide parcel containing about .4496 acres and described in Exhibit B attached hereto and made a part hereof for the purpose of constructing, installing, improving, repairing, maintaining, relocating, and removing: (a) an 8 =inch gravity sanitary sewer line at a minimum depth below the surface of four (4) feet; and (b) a connecting stub out facility on the aforesaid 8 -inch sewer line, sixty (60) feet in length. 2. A non - exclusive easement in and to a 40 foot wide parcel known as Utility Easement "A" and described in • Exhibit C attached hereto and made a part hereof for the purpose of constructing, installing, improving, repairing, maintaining, relocating, and removing: EXHIBIT A (a) an 8 -inch gravity sewer line in order to • connect the 8 -inch line referred to above to the Lift Station described below; and (b) a 6 -inch force main line between the Lift Station and the 8 -inch sewer line described above, both of which lines shall be buried a minimum depth of four (4) feet below the surface. 3. A non - exclusive easement in and to a 400.1017 square foot area described in Exhibit D attached hereto and made a part hereof and designated as the Lift Station Site for the purpose of constructing, installing, improving, repairing, maintaining and removing a lift station underground with discharge pump and connections to the 8 -inch and the 6 -inch sewer lines referred to above. B. All lines, pipes, stations, pumps, valves and all other equipment required for the above easements shall be installed by Grantee at Grantor's cost in accordance with certain plans and specifications prepared by Busch, Hutchison & Associates, Inc. and approved by Grantor. Grantee shall at Grantee's cost operate, maintain, repair and replace all pipes, lines and equipment in the above three easements which are required for their proper operation. Grantee agrees to use due care in all construction and installation work and all other work done under this Agreement, and Grantee shall be responsible to Grantor for any injuries or damages to persons or property caused by Grantee's carelessness or negligent • conduct. Grantee may cut, trim or remove any bushes or trees on the easements provided the debris is removed. -2- C. These easements are granted under and subject to • the construction by Grantor and the maintenance, repair and use of a fifty (50) foot wide concrete roadway lying east and west between the fifteen (15) foot easement and the ten (10) foot wide easement described in Exhibit A. D. In addition to the granting by Grantor of the easements to Houston Lighting & Power Company in the parcels described in Exhibits C and D, Grantee acknowledges that the fifteen (15) foot easement described in Exhibit B is also being granted by Grantor to three (3) utilities, all of which may be installing lines and equipment contemporaneously with the Grantor. Grantee agrees to coordinate its installations with these utilities described in J.(3) below. E. Grantor also grants to Grantee the right of ingress and egress on and the right to use Grantor's land adjacent to the above - described easements temporarily for the construction and installation of the sewer lines and equipment and for their repair and maintenance, and Grantee agrees to clean up Grantor's property upon completion of all work. F. Grantee agrees to the relocation of any or all pipes, lines, pumps or other equipment contained in the above three easements upon notice by Grantor that such relocation is required, which shall be accomplished by Grantor in cooperation with Grantee at Grantor's cost and expense. Grantor shall grant to Grantee such additional easements as are required for any such relocation which Grantor agrees shall only temporarily interrupt the sewage service. -3- G. Grantor reserves the right to use the easement • land described in Exhibits B, C and D provided Grantor's use does not interfere with the easements herein granted, the equipment installed on the easements, or any of Grantee's rights hereunder, and Grantor also reserves the right to grant easements to others over and through the land described in Exhibits B, C and D provided such grants do not interfere with the easements herein granted, the equipment in the easement or any of Grantee's rights hereunder. H. If the use of the easements by Grantee involves the property of others or other easements, Grantee shall make all necessary arrangements with the property owner or holder. I. Grantee shall comply with all rules, orders and laws of all local, county, state and federal authorities applicable to Grantee's use of the easements. J. This Agreement and Grant are made under and subject to all other easements and rights -of -way whether or not of record, including but not limited to: 1. Easement Agreement from the Exxon Corporation to Vintage Petroleum, Inc. recorded in Volume 146, Page 205 in the Deed Recorder's Office of Chambers County, Texas; 2. F. M. Highway No. 1405 right -of -way; 3. Utility easements in the Exhibit B, C and D parcels granted by Grantor to General Telephone and Equipment, Houston Light & Power and the Entex Division of Arkla, Inc.; and 4. All mineral interests and royalties of record • including the use of the surface for exploration and extraction of minerals. -4- The provisions hereof shall inure to the benefit of 0 the successors and assigns of Grantor. TO HAVE AND TO HOLD the above described easements and other rights herein granted unto the Grantee, its successors and assigns until the sewer lines shall be abandoned. EXHIBIT D • JAB:pfc #356 08/16/93 WATER PIPELINE EASEMENT KNOW ALL MEN BY THESE PRESENTS, that USX Corporation, formerly known as United States Steel Corporation, incorporated in the State of Delaware, hereinafter referred to as the "Grantor ", for good and valuable consideration, and intending hereby to be legally bound, does by these presents hereby grant, sell and convey unto the City of Baytown, Chambers County, Texas, hereinafter referred to as the "Grantee ", a non - exclusive Easement in and to a ten (10) foot wide parcel containing approximately .3023 acres in the John Steele Survey A -227, Chambers County, Texas, described on Exhibit A attached hereto and made a part hereof, herein called the "Easement ", for the purpose of constructing, installing, and connecting by the Grantee at the Grantor's cost in accordance with plans and specifications prepared by Busch, Hutchison & Associates, Inc. and approved by Grantor: an underground water pipeline and all fixtures and equipment necessary for the installation and operation of the water pipeline, which shall be buried at least forty -eight (48) inches below the surface of the Easement, and which shall be operated, maintained, repaired and replaced by Grantee at Grantee's cost. A. Grantee agrees to use due care in all construction and installation of the pipeline and all other work performed under this Easement Grant, and Grantee shall be responsible to Grantor for any injuries or damages to person or property caused by Grantee's carelessness or negligent conduct. E. Grantee agrees to relocation of the pipeline contained in the above Easement upon notice by Grantor that such relocation is required, which shall be accomplished by Grantor in cooperation with Grantee at Grantor's cost and expense.
