Ordinance No. 6,690930708 -7 ORDINANCE NO. 6690 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FOUR ! THOUSAND THREE HUNDRED AND N01100 DOLLARS ($4,300.00) TO ANGEL BROTHERS ENTERPRISES, INC. FOR THE RENTAL OF HEAVY EQUIPMENT FOR REPAIRS OF THE STORM WATER DRAINAGE SYSTEM FOR THE PINEHURST II SUBDIVISION; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the storm water drainage system for the Pinehurst II subdivision has failed; and WHEREAS, TEX.L.GOV'T.CODE ANN. S 252.022, provides that in case of procurements for the protection of public health or safety, • the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the rental of heavy equipment for repairs of the storm water drainage system for the Pinehurst II subdivision have been obtained, and Angel Brothers Enterprises, Inc., is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Angel Brothers Enterprises, Inc. of the sum of FOUR THOUSAND THREE HUNDRED AND NO /100 DOLLARS ($4,300.00) for the rental of heavy equipment for repairs of the storm water drainage system for the Pinehurst II subdivision is hereby authorized. Section 3: That pursuant to the provisions of TEX.L.GOV'T.CODE ANN. S 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N01100 DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty -five (25 %) or decreased by more than twenty -five (25 %) percent without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
