ORDINANCE NO. 6670
AN ORDINANCE AMENDING CHAPTER 2 "ADMINISTRATION," ARTICLE
II "BOARDS AND COMMISSIONS," DIVISION 7 "BAYTOWN CULTURAL
ARTS COUNCIL," SECTION 2 -66 "CREATION OF CULTURAL ARTS
COUNCIL," SECTION 2 -67 "APPOINTMENT OF COUNCIL;
QUALIFICATIONS," AND SECTION 2 -67.1 "TERMS OF
COUNCILMEMBERS," OF THE CODE OF ORDINANCES, CITY OF
BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Chapter 2 "Administration," Article II
"Boards and Commissions," Division 7 "Baytown Cultural Arts
Council," Section 2 -66 "Creation of Cultural Arts Council," of the
Code of Ordinances, City of Baytown, Texas, is hereby amended to
read as follows:
ARTICLE II. BOARDS AND COMMISSIONS
Division 7. Baytown Cultural Arts Council.
Sec. 2 -66. Creation of Cultural Arts Council.
There is hereby created the Baytown Cultural Arts Council to
gather information and promote activities relative to cultural
arts, to improve communications between cultural arts groups,
to improve communications between cultural arts groups and the
Baytown citizenry, and to present cultural arts opportunities
and activities to the Baytown citizenry.
Section 2: That Chapter 2 "Administration," Article II
"Boards and Commissions," Division 7 "Baytown Cultural Arts
Council," Section 2 -67 "Appointment of Council; Qualifications," of
the Code of Ordinances! City of Baytown, Texas, is hereby amended
to read as follows:
ARTICLE II. BOARDS AND COMMISSIONS
Division 7. Baytown Cultural Arts Council.
Sec. 2 -67. Appointment of Council; Qualifications.
(a) The Baytown Cultural Arts Council shall consist of five
(5) members to be appointed by City Council. The members of
such board shall serve at the pleasure of the City Council and
may be removed by City Council with or without cause.
(b) All members of the Baytown Cultural Arts Council shall be
active in Baytown cultural arts organizations.
Section 3: That Chapter 2 "Administration," Article II
"Boards and Commissions," Division 7 "Baytown Cultural Arts
Council," Section 2 -67.1 "Terms of Councilmembers," of the Code of

Ordinances, City of Baytown, Texas, is hereby amended to read as
follows:
ARTICLE II. BOARDS AND COMMISSIONS
Division 7. Baytown Cultural Arts Council.
Sec. 2Y -67.1. Terms of Councilmembers.
The terms of the persons appointed as members of the Baytown
Cultural Arts Council shall be as follows:
(a) Of the initial five (5) councilmembers appointed by City
Council, three (3) shall be appointed to serve three -year
terms, one (1) shall be appointed to serve a two -year term,
and one (1) shall be appointed to serve a one -year term.
(b) Subsequent terms of all councilmembers shall be for three
(3) years.
(c) Appointments to vacancies shall be for the unexpired term
of the position to which the appointment is made.
(d) Councilmembers shall serve until their successors have
been appointed.
Section 4: All ordinances or parts of ordinances inconsistent
with the terms of this ordinance are hereby repealed; provided
however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 5: If any provisions, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 6: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 10th day of June,
1993.
