AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR THE
PUBLIC HEARINGS ON THE PROPOSED ANNEXATION OF THE CRACKER
BARREL OLD COUNTRY STORE ON INTERSTATE 10 AT GARTH ROAD;
DIRECTING THE PREPARATION OF A SERVICE PLAN; AUTHORIZING
AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SUCH
PUBLIC HEARINGS; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: On the 27th day of May, 1993, at 6:45 o'clock
p.m. and at 7:00 o'clock p.m., in the City Council Chambers
of the City Hall of Baytown, Texas, the City Council will hold
public hearings giving all interested parties the right to appear
and be heard on the proposed annexation by the City of Baytown,
Texas, of the property described in Exhibit "A" which is attached
hereto and made a part hereof for all intents and purposes.
Section 2: In compliance with TEX.L.GOV'T.CODE ANN.
43.056, as amended, the Planning Department is hereby
directed to prepare a service plan that provides for the
extension of municipal service into the area described in
Exhibit "A."
Section 3: The City Clerk of the City of Baytown is hereby
authorized and directed to cause notice of each public hearing to
be published once in the newspaper having general circulation in
the City and in the above described territory not more than
twenty (20) days nor less than ten (10) days prior to the date of
each public hearing, all in accordance with TEX.L.GOV'T.CODE ANN.
§ 43.052.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 13th day of May,
1993.

Nathaniel Herman Conder in Cause No. 82 -41667 in the District Court
of Harris County, Texas, 245th Judicial District, said 20.335 acre
tract being better described in deed from Robert L. Gillette, Trustee, to
N. H. Conder et ux, dated April, 1977 and recorded under File Number
F101734, Film Code Number 162 -14 -2330 of the Harris County official
Public Records of Real Property (H.C.O.P.R.R.P.), being a part of Lot
5 of the subdivision of said George Ellis survey, Abstract No. 21; said
0.8677 of one acre of land being more particulary described by metes and
bounds as follows:
commENCING at a 5/8 -inch iron rod found for the southerly end of a cut-
back corner, being in the north right -of -way line of Interstate Highway
10, (width varies), at the intersection with the easterly right -of -way

with cap found for corner, being in the existing easterly right -of -way
