Ordinance No. 6,618930506 -1 ORDINANCE N0. 6518 AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON THE 5TH DAY OF JUNE 1993, FOR THE PURPOSE OF ELECTING A COUNCILMEMBER FROM DISTRICT NO. THREE (3) ; PROVIDING FOR THE ELECTION OFFICERS; DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS; ESTABLISHING THE CENTRAL COUNTING STATION; PROVIDING FOR AN EARLY BALLOT BOARD FOR EARLY BALLOTS; AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. WHEREAS, on the 1st day of May, 1993, the Regular Municipal Election of the City of Baytown was held for the purposes of electing three councilmembers from the respective three Districts 1, 2, and 3, and the returns of said election having been duly made by the Election Officials and the City Council having canvassed said returns and determined the results of said Election on this 6th day of May, 1993; and WHEREAS, it is determined from the canvassing of said returns that no candidate for Councilmember from District 3 received a majority of the votes cast at the regular election for the office of which he was candidate, and accordingly, pursuant to Section 94 of Article IX of the Charter of the City of Baytown, it is the duty of the City Council to order a Special Election for the purposes of submitting to a vote of the qualified voters of said City, the names of the two eligible candidates receiving the highest number of votes at the regular election for the office in order that the voters may designate and elect one of the two candidates; and WHEREAS, in ordering such Special Election, it is the duty of the City Council to determine the eligibility of the candidates whose names are to appear on the ballot for said election; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby finds, determines and declares that as determined by the canvass of the election returns this day accomplished by the City Council, the two eligible candidates receiving the highest number of votes for the office of Councilmember from District No. 3 are Ronald "Butch" Priddy and Manuel Escontrias. Section 2: That a Special Election of the City of Baytown, as provided in Section 94, Article IX of the Charter of said City, shall be held between the hours of seven (7:00) o'clock a.m. and seven (7:00) o'clock p.m. on the 5th day of June, 1993, in said City for the purpose of electing the following members of the City Council: Councilmember from District No. Three; 930506 -1a Section 3: That said City is hereby divided into Election Precincts and their polling places shall be and election officials shall be, for the purpose of this election as follows: PRECINCT NO. Travis Mollie Lamonte Elementary Judge & Presiding 100 Robin Road Officer Katherine Yates Alternate Judge Section 4: That this election shall be held in accordance with, and shall be governed by, the election laws of the State of Texas. That the form of said ballot shall be substantially as follows: OFFICIAL BALLOT COUNCILMAN DISTRICT NO. 3 RONALD "BUTCH" PRIDDY MANUEL ESCONTRIAS Section 5: Each qualified voter who desires to cast an early vote shall be entitled to an official ballot and the right to cast such ballot in accordance with the provisions of the Texas Election Code. 2 930506 -1b Section 6: The City Council Chamber and Conference Room area in City Hall of the City of Baytown, 2401 Market Street is hereby established as the Central Counting Station to receive and tabulate voted ballots. The City Clerk is hereby appointed Manager of the Central Counting Station and also Tabulation Supervisor. Ronald G. Embry is hereby appointed Presiding Judge for the Central Counting Station. Section 7: There is hereby created an Early Voting Ballot Board which shall process early voting results. Sandra Northcutt is hereby appointed Presiding Judge of the Early Voting Ballot Board. Section 8: The Mayor is hereby directed to give notice of said election by publishing a copy of the Election Proclamation and Notice in a newspaper of general circulation within said City; said publication to be made no earlier than the thirtieth (30th) day or later than the tenth (lath) day prior to the date of said election. Section 9: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
