ORDINANCE NO. 6574
AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 6449
PASSED ON NOVEMBER 23, 1992; ESTABLISHING FOUR YEAR TERMS
FOR ALL MEMBERS OF THE BAYTOWN AREA COMMUNITY LONG -RANGE
PLANNING COMMISSION; REPEALING CONFLICTING ORDINANCES;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
PUBLICATION AND EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, does hereby amend that portion of Section 1 of Ordinance No.
6449 passed on November 23, 1992 which deals with Section 2 -65 of
the Code of Ordinances, to read as follows:
Section 1: That Division 6, Chapter 2 (Sections 2 -63
through 2 -65) of the Code of Ordinances, City of Baytown,
Texas, is hereby amended to read as follows:
"DIVISION 6. BAYTOWN AREA COMMUNITY LONG -RANGE PLANNING
COMMISSION"
Section 2 -65. Appointment of members.
The members shall be appointed in the following manner:
(1) City Council shall appoint ten of the commission members.
(2) The Lee College Board of Regents shall appoint one member
from the current members of the Board of Regents.
(3) The Goose Creek Consolidated Independent School District
Board of Trustees shall appoint one member from the
current members of the Board of Trustees.
(4) The City Manager shall nominate, subject to City Council
confirmation, three commission members. In the event the
Board of Regents or the Board of Trustees fails to
appoint a member within 60 days of submittal of the
request to so appoint a member, the City Manager shall
nominate, subject to City Council confirmation, one or
more additional member(s) to serve in the place of the
Board of Regents member and /or the Board of Trustees
member, as appropriate.
In making the initial appointments, the City Council
shall designate which seven (7) members shall serve initially
for three (3) years and which eight (8) members shall be
appointed for four (4) year terms. However, the City Council
may remove a member at any time by vote of the City Council in
public session.

As the terms of office of the individual members
terminate the City Council shall, as soon as possible, appoint
members to fill such vacancies for the new terms. The
Council, if interim vacancies occur, shall appoint a successor
for the remainder of such term.
Section 2: Sections 2 -63, 2.64, 2 -65.1, 2 -65.2, 2 -65.3,
2 -65.4, and 2 -65.5 are unchanged from the original ordinance passed
on November 23, 1992.
Section 3: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided however, that such repeal shall be only to the
extent of such inconsistency and in all other respects this
ordinance shall be cumulative of other ordinances regulating and
governing the subject matter covered by this ordinance.
Section 4: If any provisions, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 5: This ordinance shall take effect immediately from
and after its passage by the City Council of the City of Baytown,
Texas.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 25th day of March,
