ORDINANCE NO. 6572
AN ORDINANCE RENEWING THE CONTRACT OF HAZELWOOD
ENTERPRISES, INC. FOR THE ANNUAL SANITARY LANDFILL
CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN
OF THE SUM OF TWO HUNDRED NINETY THOUSAND SIX HUNDRED
FOUR AND NO 1100 DOLLARS ($290,644.00); MAKING OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, Hazelwood Enterprises, Inc. was awarded the annual
sanitary landfill contract on April 1, 1986, pursuant to
competitive bidding procedures, which contract included an
option by the parties to renew for nine (9) additional one (1) year
periods; and
WHEREAS, Hazelwood Enterprises, Inc. has indicated their
willingness to renew the contract for an additional year with an
increase of 14 cents per cubic yard of loose solid waste, an
increase of 14 cents per cubic yard of compacted solid waste, and
an increase of 23 cents per cubic yard of sewer sludge; and
WHEREAS, the Administration has reviewed the market
conditions and recommends renewal as being in the best interest
of the City; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown
hereby renews the contract of Hazelwood Enterprises, Inc. for the
annual sanitary landfill contract for the sum of TWO HUNDRED
NINETY THOUSAND SIX HUNDRED FOUR AND N01100 DOLLARS ($290,604.00)
and authorizes payment thereof.
Section 2: That pursuant to the provisions of
TEX.L.GOV'T.CODE ANN. § 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND N01100
DOLLARS ($15,000.00) or less, provided that the original contract
price may not be increased by more than twenty --five (25 %) percent
or decreased by more than twenty -five (25 %) percent without the
consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
