ORDINANCE NO. 6569
AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR THE
PUBLIC HEARINGS ON THE PROPOSED ANNEXATION OF THE JACK IN
BOX LOCATION AT INTERSTATE 10 AND GARTH ROAD; DIRECTING
THE PREPARATION OF A SERVICE PLAN; AUTHORIZING AND
DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF
SUCH PUBLIC HEARINGS; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: On the 8th day of April, 1993, at 6:45
o'clock p.m. and at 7:00 o'clock p.m., in the City Council
Chambers of the City Hall of Baytown, Texas, the City Council
will hold public hearings giving all interested parties the right
to appear and be heard on the proposed annexation by the City of
Baytown, Texas, of the property described in Exhibit "A" which is
attached hereto and made a part hereof for all intents and
purposes.
Section 2: In compliance with TEX.L.GOV'T.CODE ANN.
§ 43.056, as amended, the Planning Department is hereby directed
to prepare a service plan that provides for the extension of
municipal service into the area described in Exhibit "A."
Section 3: The City Clerk of the City of Baytown is hereby
authorized and directed to cause notice of each public hearing to
be published once in the newspaper having general circulation in
the City and in the above described territory not more than
twenty (20) days nor less than ten (10) days prior to the date of
each public hearing, all in accordance with TEX.L.GOV'T.CODE ANN.
§ 43.052.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 25th day of March,
1993.

FIELD NOTES FOR JACK -IN -THE BOX
A tract of land containing 0.9353 acres out of Lot 5 of a
Subdivision of the George Ellis Survey (A -21), Harris County,
Texas, being more particularly described by metes and bounds as
follows:
BEGINNING at a 3/4" iron pipe found at the intersection of the
easterly line of Garth Road (80' ROW) with the northwesterly end
of a 450 cut corner on the north side of I.H. 10 access road, said
iron pipe being the Most westerly Southwest Corner of the herein
described tract of land;
Thence, South 54 °06158" East with the 450 cut corner, a distance of
69.93 feet to a 5/8" iron rod set in the northerly line of I.H. 10
access road for the Most Southerly Southwest Corner of this tract;
Thence, North 80 015'19" East with the northerly line of I.H. 10
access road, passing at 120.00 feet a 3/4" iron pipe, in all a
total distance of 150.00 feet to a 1 -1/2" iron pipe found for the
southwesterly corner of the Whataburger tract and the Southeasterly
Corner of this tract;
Thence, North 8 029'16" West with the westerly line of the
Whataburger tract and the easterly line of this tract, a distance
of 210.00 feet to a 5/8" iron rod set for the Northeasterly Corner
of this tract;
Thence, South 80 015119" West with the southerly line of a concrete
driveway serving the Whataburger, a distance of 200.00 feet to a
5/8" iron rod set in the easterly line of Garth Road (80' ROW) for
the Northwesterly Corner of this tract;
Thence, South 8 °29116" East with the easterly line of Garth Road
(80' ROW) , passing at 40 feet a point from which an axle was found
(0.021S. 0.591W.), in all a total distance of 160.00 feet to the
Point of Beginning, enclosing 40,740 sq. ft. (0.9353 acres) of
land.
