ORDINANCE NO. 6560
AN ORDINANCE ACCEPTING THE BID OF VAN WATERS & ROGERS
INC., PUBLIC HEALTH EQUIPMENT & SUPPLY CO., AND B & G
CHEMICALS & EQUIPMENT CO., INC. FOR THE ANNUAL CHEMICAL
CONTRACT FOR MOSQUITO CONTROL AND AUTHORIZING PAYMENT BY
THE CITY OF BAYTOWN, THE SUM OF SIXTY THOUSAND NINE
HUNDRED FOUR AND 20/100 DOLLARS ($60,904.20) ; MAKING
OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, the City Council of the City of Baytown did
authorize the Purchasing Department for the City of Baytown to
advertise for bids for the annual chemical contract for mosquito
control to be received February 25, 1993; and
WHEREAS, notice to bidders as to the time and place, when
and where the contract would be let was published pursuant to the
provisions of Section 74 of the Charter of the City of Baytown;
and
WHEREAS, all bids were opened and publicly read at City Hall
at 2:00 p.m., Thursday, February 25, 1993, as per published
notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of Van Waters & Rogers Inc. for Item No. 1
of the annual chemical contract for mosquito control for the sum of
SEVEN THOUSAND TWO HUNDRED EIGHTY AND N01100 DOLLARS ($7,280.00),
and authorizes payment thereof.
Section 2: That the City Council of the City of Baytown
hereby accepts the bid of Public Health Equipment & Supply Co. for
Item No. 2 of the annual chemical contract for mosquito control for
the sum of FORTY -THREE THOUSAND NINE HUNDRED THIRTY -SEVEN AND
50/100 DOLLARS ($43,937.50), and authorizes payment thereof.
Section 3: That the City Council of the City of Baytown
hereby accepts the bid of B & G Chemicals & Equipment Co., Inc. for
Items No. 3 and 5 of the annual chemical contract for mosquito
control for the sum of NINE THOUSAND SIX HUNDRED EIGHTY -SIX AND
70/100 DOLLARS ($9,686.70), and authorizes payment thereof.
Section 4: That pursuant to the provisions of
TEX. L.GOV'T.CODE ANN. § 252.048, the City Manager is hereby granted
general authority to approve any change order involving a decrease
or an increase in costs of FIFTEEN THOUSAND AND N01100 DOLLARS
($15,000.00) or less, subject to the provision that the original
contract price may not be increased by more than twenty -five (25%)
or decreased by more than twenty -five (25 %) percent without the
consent of the contractor to such decrease.

Section 5: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the llth day of March,
