Ordinance No. 6,530930128 -22 ORDINANCE NO. 6530 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS REALLOCATING CERTAIN POSITIONS IN THE FIRE DEPARTMENT OF THE CITY OF BAYTOWN; PROVIDING FOR THE STATUS OF PRESENT EMPLOYEES; AMENDING THE BUDGET ORDINANCE OF THE CITY OF BAYTOWN FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1992 AND ENDING SEPTEMBER 30, 1993, TO REFLECT SUCH REALLOCATION OF POSITIONS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Chief of the City of Baytown Fire Department has recommended to the City Council that certain positions in the fire department be reallocated; and WHEREAS, the Chief of the City of Baytown Fire Department has made these recommendations based on his personal study of such positions, the future needs of the fire department and his experience within such department; and WHEREAS, these recommended changes would assist the orderly, efficient operation of the fire department and assist in attaining the goals of economy and efficiency through the strengthening of the chain of command, balancing command responsibilities, and providing the fire department with a broader command staff; and WHEREAS, the recommended changes would result in no required additions to the budget for the fire department and would result in no additional personnel for the fire department; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown finds that the goals of efficiency and economy would best be served by reallocating the number of positions in the classification of fire battalion chief from four (present) to five (future) and by reducing the number of lieutenants from nineteen (present) to eighteen (future). Section 2: That such additions and reductions shall be effective upon the effective date of this ordinance, however, no present member of the classified service shall suffer any decrease in salary or loss of position and that the additional added fire battalion chief position shall be filled from within the Baytown Fire Department pursuant to civil service rules and regulations and eligibility lists applicable to the position of fire battalion chief. Section 3: That the budget of the City of Baytown for fiscal year October 1, 1992 to September 30, 1993 as adopted by Ordinance No. 6346 is hereby amended to read as follows: FIRE 2020 -71 -1 FIRE BATTALION CHIEF 2020 -71 -1 LIEUTENANT 930128 -22a 5 $3,404- $3,575 18 $3,087 - $3,241 Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 6: This ordinance shall take effect immediately from and after its passage by the City Council.
