Ordinance No. 6,529930128 -21 ORDINANCE NO. 6529 AN ORDINANCE AMENDING SECTION 34- 56(d)(2), "OTHER INDUSTRIAL USERS," OF CHAPTER 34, "WASTE DISPOSAL" OF THE CODE OF ORDINANCES, CITY OF BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That Section 34- 56(d) (2), "Other Industrial Users ", of Chapter 34, "Waste Disposal" of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: Sec. 34- 56(d). Other industrial users. (2) Persons or owners discharging industrial wastes which exhibit none of the characteristics of waste whose discharge is prohibited by this chapter or other applicable local, state, or federal regulation, other than excessive suspended solids or BOD, but having a concentration level four (4) times greater (for a fifteen minute duration) than that of "normal domestic wastewater," as defined in section 34 -11 of article II of the chapter, as measured by suspended solids and BOD or a concentration level during a twenty -four (24) hour period averages a suspended solids level or BOD content in excess of normal domestic wastewater, shall be required to pretreat the industrial wastes to meet the required levels of normal domestic wastewater. However, such treatment if: non - prohibited wastes may be accepted for (1) The waste will not cause damage to the public sewers, or be in violation of section 34-12(a) of article II of this chapter as prohibited discharges; (2) The waste will not impair the treatment process; (3) The donor of the waste enters into a contractual and permit agreement as set forth in Article II, Chapter 34 of the Code of Ordinances. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. 930128 --21a Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
