ORDINANCE NO. 6496
AN ORDINANCE AUTHORIZING THE PAYMENT OF THE SUM OF THREE
THOUSAND NINE HUNDRED TWENTY AND N01100 DOLLARS
($3,920.00) TO PENTA1ATION AS THE SOLE SOURCE FOR THE
POSITION CONTROL SYSTEM; MAKING OTHER PROVISIONS RELATED
THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the accounting department of the City of Baytown is
in need of a Position Control System; and
WHEREAS, TEX.L.GOV'T.CODE ANN. § 252.022 provides that when
the functional requirements of the City can only be satisfied by
one source, the requirement for competitive bids is not
applicable; and
WHEREAS, the procurement of the Position Control System can
be satisfied by only one source, Pentamation, NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that only one source can satisfy the needs
of the City for the Position Control System.
Section 2: That payment to Pentamation, as the sole
source, of THREE THOUSAND NINE HUNDRED TWENTY AND N01100 DOLLARS
($3,920.00), for the above- described Position Control System is
hereby authorized.
Section 3: That pursuant to the provisions of
TEX.L.GOV'T.CODE ANN. S 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND N01100
DOLLARS ($15,000.00) or less, subject to the provision that the
original contract price may not be increased by more than twenty -
five (25 %) or decreased by more than twenty -five (25 %) percent
without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 14th day of
January, 1993.
