ORDINANCE NO. 6454
AN ORDINANCE RENEWING THE CONTRACT OF DEER PARK LUMBER
. CO., INC. AND THE GLIDDEN PAINT CO. FOR THE ANNUAL
MASONRY, LUMBER, PAINT AND CONSTRUCTION CONTRACT AND
AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN OF THE SUM OF
THIRTY -SEVEN THOUSAND SEVEN HUNDRED SEVEN AND 91/100
DOLLARS ($37,707.91) ; MAKING OTHER PROVISIONS RELATED
THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, Deer Park Lumber Co., Inc. and The Glidden Paint Co.
were awarded the annual masonry, lumber, paint and construction
contract on January 9, 1991, pursuant to competitive bidding
procedures, which contract included an option by the parties to
renew for one (1) additional one (1) year period; and
WHEREAS, Deer Park Lumber Co., Inc. and The Glidden Paint Co.
have indicated their willingness to renew the contract for an
additional year under the same terms and conditions; and
WHEREAS, the Administration has reviewed the market
conditions and recommends renewal as being in the best interest
of the City; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown
hereby renews the contract of Deer Park Lumber Co., Inc. for
Sections I, II, and III of the annual masonry, lumber, paint and
construction contract for the sum of THIRTY THOUSAND TWENTY -
SEVEN AND 16/100 DOLLARS ($30,027.16), and authorizes payment
thereof.
Section 2: That the City Council of the City of Baytown
hereby renews the contract of The Glidden Paint Co. for Section IV
of the annual, masonry, lumber, paint and construction contract
for the sum of SEVEN THOUSAND SIX HUNDRED EIGHTY AND 75/100
DOLLARS ($7,680.75), and authorizes payment thereof.
Section 3: That pursuant to the provisions of
TEX.L.GOV'T.CODE ANN. § 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or. an increase in costs of Fifteen Thousand and No /100
($15,000.00) Dollars or less, provided that the original contract
price may not be increased by more than twenty -five (25 %) percent
or decreased by more than twenty -five (25 %) percent without the
consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
