ORDINANCE NO. 6449
AN ORDINANCE AMENDING DIVISION 6 OF CHAPTER 2 (SECTIONS
2 -63 THROUGH 2 -65) "TRAFFIC COMMISSION" OF THE CODE OF
ORDINANCES; CREATING THE BAYTOWN AREA COMMUNITY LONG -
RANGE PLANNING COMMISSION; PROVIDING A REPEALING CLAUSE;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Division 6, Chapter 2 (Sections 2 -63 through
2 -65) of the Code of Ordinances, City of Baytown, Texas, is hereby
amended to read as follows:
"DIVISION 6. BAYTOWN AREA COMMUNITY LONG -RANGE PLANNING COMMISSION"
Section 2 -63. Commission created.
An agency of the City Council is hereby created which shall be
known as the Baytown Area Community Long -Range Planning Commission,
and such commission shall consist of fifteen (15) members.
Section 2 -64. Makeup of commission.
The makeup of the commission shall be demographically and
geographically representative of the community and continue to
represent the issues identified in the City of Baytown
Comprehensive Plan. Eight (8) members shall be appointed during
odd - numbered years and seven (7) members shall be appointed during
even - numbered years. At least one member shall be appointed from
each city council district and two members shall be appointed from
the portion of the city's ETJ lying outside of the city's corporate
boundaries. Terms of such appointments shall begin on the first
day of the month of January and extend for four calendar years.
section 2 -65. Appointment of members.
The members shall be appointed in the following manner:
(1) City Council shall appoint ten of the commission members.
(2) The Lee College Board of Regents shall appoint one member from
the current members of the Board of Regents.
(3) The Goose Creek Consolidated Independent School District Board
of Trustees appoint one member from the current members of the
Board of Trustees.
(4) The City Manager shall nominate, subject to City Council
• confirmation, three commission members. In the event the
Board of Regents or the Board of Trustees fails to appoint a

member within 60 days of submittal of the request to so
• appoint a member, the City Manager shall nominate, subject to
City Council confirmation, one or,more additional member to
serve in the place of the Board of Regents member and /or the
Board of Trustees member, as appropriate.
In making the initial appointments, the City Council shall
designate which seven (7) members shall serve initially for three
(3) years and which eight (8) members shall be appointed for four
(4 ) year terms. Thereafter all appointments shall be for three ( 3 )
year terms. However, the City Council may remove a member at any
time by vote of the City Council in public session.
As the terms of office of the individual members terminate the
City Council shall, as soon as possible, appoint members to fill
such vacancies for the new terms. The Council, if interim
vacancies occur, shall appoint a successor for the remainder of
such term.
Section 2 -65.1 Attendance at meetings; chairman.
Any commission member who misses three (3) consecutive regular
meetings shall be deemed no longer interested in serving and the
commission shall ask the City Council to appoint, or request the
appointing board to appoint, a new member to fill the interim
vacancy.
The commission shall elect a chairperson and vice- chairperson
at the first meeting of each year. The City of Baytown Director of
Planning shall provide staff to take minutes and serve as secretary
to the commission.
Section 2 -65.2 Rules of procedure.
The commission is hereby empowered to establish its own
parliamentary procedure; provided that such shall not be in
conflict with the laws applicable to the commission or the
following:
A quorum shall consist of a majority of the entire membership
of the commission and any issue to be voted on shall be
resolved by a majority of those present. The chairperson
shall be entitled to vote upon any question, but shall have no
veto power.
Meetings shall be open to the public and minutes shall be treated
as a public record.

Section 2 -65.3 Powers and duties.
• The commission shall exercise the powers and shall be required
to:
(1) Develop an action strategy to accomplish the objectives of
each element of the City of Baytown Comprehensive Plan as
currently exists or as may exist in the future.
(2) Monitor implementation of the City of Baytown Comprehensive
Plan.
(3) Develop and submit to the City Council recommendations to
revise the City of Baytown Comprehensive Plan.
(4) Make at least annual reports to the community, presented
through the City Council, as to the status of efforts to
implement the City of Baytown Comprehensive Plan.
(5) Present annually, for City Council action, a five -year
strategy for implementation of the City of Baytown
Comprehensive Plan along with an annual action agenda. A
biennial strategy may be submitted in lieu of a five -year
strategy during the initial year of the commission.
(6) Make studies of comprehensive planning issues and prepare and
recommend to City Council and other taxing entities plans to
address these issues.
(7) Provide decision - making and advisory boards (for example, but
not limited to, the Community Development Advisory Board,
Parks and Recreation Board, Growth Management and Development
Advisory Commission, City Council, Baytown Housing Authority,
etc.) with comments regarding proposed programs (such as the
CDBG proposals, capital facilities projects, housing
developments, etc.) as they relate to the Goals, Objectives,
and Policies contained in the City of Baytown Comprehensive
Plan.
(8) Review and comment on proposed new facilities (expansion or
disposition of existing facilities) to the appropriate
governing or advisory board. The commission's comments are to
be made part of the public record.
(9) Recommend to the City Council appointment of citizen
committees to assist the commission in undertaking its
comprehensive planning studies and associated duties. A
member of the commission is to be responsible for coordinating
the committee activities with the commission.
(10) Conduct public involvement meetings throughout the community
on at least a biennial basis.

(11) Make, amend, extend or add to the master plan for the
development of the City and recommend adoption by City
Council.
(12) Perform such other functions as may be duly delegated to them
by the City Council.
Section 2 -65.4 Meetings.
The commission is to meet at least quarterly. Meetings shall
be held at the place and time and date stated on the notice of
meeting which shall be posted at the City Hall. However, meetings
of commission committees shall not be required to be posted but
shall be considered open to the public.
Section 2 -65.5 commission is adjunct.ot City Council.
The commission is hereby declared to be an adjunct of the City
Council. The City Manager and all other administrative personnel
of the City are hereby authorized and directed to cooperate with
and assist the commission at all reasonable times. Any reference
in other sections of the City of Baytown Code of Ordinances to the
planning commission is to be hereinafter construed as to refer to
the Growth Management and Development Advisory Commission.
Section 2: All ordinances or parts of ordinances inconsistent
with the terms of this ordinance are hereby repealed; provided
however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection,
paragraph, sentence, clause or phrase of this ordinance or the
application of same to any person or set of circumstances, shall
for any reason be held unconstitutional, void or invalid, such
invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other persons
or sets of circumstances and to this end all provisions of this
ordinance are declared to be severable.
Section 4: This ordinance shall take effect on January 14,
1993.
