• AN ORDINANCE AUTHORIZING THE PAYMENT OF THE SUM OF
NINE THOUSAND SEVEN HUNDRED NINETY -SIX AND N01100
($9,796.00) DOLLARS TO MILE -HI T FIRE EQUIPMENT, INC. AS
THE SOLE SOURCE FOR THE PURCHASE AND INSTALLATION OF A
TELMA BRAKE RETARDER ON THE FIRE APPARATUS; MAKING OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, the Baytown Fire Department is in need of a TELMA
brake retarder to improve brake performance and decrease
maintenance costs on the fire apparatus; and
WHEREAS, TEX.L.GOV'T.CODE ANN. § 252.022 provides that when
the functional requirements of the City can only be satisfied by
one source, the requirement for competitive bids is not
applicable; and
WHEREAS, the procurement of the purchase and installation of
a TELMA brake retarder on the fire apparatus can be satisfied by
only one source, Mile -Hi T Fire Equipment, Inc., NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that only one source can satisfy the needs
of the City for the purchase and installation of a TELMA brake
retarder on the fire apparatus.
Section 2: That payment to Mile -Hi T Fire Equipment, Inc.,
as the sole source, of NINE THOUSAND SEVEN HUNDRED NINETY -SIX AND
N01100 ($9,796.00) DOLLARS, for the above - described the purchase
and installation of a TELMA brake retarder on the fire apparatus
is hereby authorized.
Section 3: That pursuant to the provisions of
TEX.L.GOV'T.CODE ANN. S 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND N01100
($15,000.00) DOLLARS or less, subject to the provision that the
original contract price may not be increased by more than twenty -
five (25 %) or decreased by more than twenty -five (25 %) percent
without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
