ORDINANCE NO. 6425
AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN
• BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE
ANNEXATION OF THE BAYTOWN NISSAN, INC. PROPERTY -
INTERSTATE 10 SITE; WHICH SAID TERRITORY LIES ADJACENT
TO AND ADJOINS THE PRESENT BOUNDARY LIMITS FOR THE CITY
OF BAYTOWN, TEXAS.
WHEREAS, there being no request for an "on- site" hearing,
two public hearings before the City Council of the City of
Baytown, Texas, where all interested persons were provided with
an opportunity to be heard on the proposed annexation of the
property described in Section 1 of this ordinance, were held, one
at 6:45 p.m. and the other at 7:00 p.m., on the 8th day of
October, 1992, in the City Council Chamber of the City Hall of
the City of Baytown, Texas, which date is not more than forty
(40) nor less than twenty (20) days prior to the institution of
annexation proceedings; and
WHEREAS, notices of such public hearings were published in a
newspaper having general circulation in the City of Baytown,
Texas, and in the below described territory on the 28th day of
September, 1992, which date is not more than twenty (20) nor less
than ten (10) days prior to the date of such public hearings; and
WHEREAS, the total corporate area of the City of Baytown,
Texas, on the 1st day of January, 1992, was 32.06 square miles;
and
WHEREAS, the population of the City of Baytown, Texas, is
approximately 65,159 inhabitants; and
WHEREAS, the below described territory lies within the
extraterritorial jurisdiction of the City of Baytown, Texas; and
WHEREAS, the below described territory lies adjacent to and
adjoins the City of Baytown, Texas; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the following described land and territory
lying adjacent to and adjoining the City of Baytown is hereby
added and annexed to the City of Baytown, Texas, and shall
hereinafter be included within the boundary limits of the City of
Baytown, Texas, and present boundary limits of such City, at the
various points contiguous to the area hereinafter described, are
altered and amended so as to include said area within the
corporate limits of the City of Baytown, Texas, to -wit:

• Section 2: The above described territory and the area so
annexed shall be a part of the City of Baytown, Texas, and the
property so added hereby shall bear its pro rata of the taxes
levied by the City of Baytown, Texas, and the inhabitants thereof
shall be entitled to all of the rights and privileges of all the
citizens of the City of Baytown and shall be bound by the acts,
ordinances, resolutions, and regulations of the City of Baytown,
Texas.
Section 3: In accordance with TEX.L.GOV'T.CODE ANN. S
43.056, as amended, the service plan prepared by the City for
providing municipal services to the annexed area is attached as
Exhibit "B" and is hereby approved.
Section 4: This ordinance shall be published and passed in
the manner provided in Article 1, Section 9, of the Charter of
the City of Baytown, Texas.

Annexation Notes
for
Baytown Nissan
BEING a tract of land situated in the George Ellis Survey, Abstract
No. 21, Harris County, Texas, and being out of and a part of a
26.4431 acre tract of land conveyed to George Gilman, Trustee, by-
Velma, Incorporation, be deed dated July 11, 1977, and recorded
under Film Code Number 194 -15 -0460 of the Real Property records of
Harris County, Texas, more particularly described by metes and
bounds as follows, to -wit:
BEGINNING at a 1/2 inch iron rod found for the Southwest corner of
this tract of land, the Southwest corner of said tract and the
Southeast corner of the UPS Distribution Center tract of land and
in the North right of way line of Interstate Highway No. 10.
THENCE North 09 deg 55 min 44 sec West with the West line of this
tract, and the East line of the UPS tract of land a distance of
698.30 feet, said line also being the existing Baytown City limit
line, to a 1/2 inch iron rod found for the Northwest corner of this
tract of land called a 20 foot drainage easement in easement dated
August 12, 1991, and recorded under Harris County Clerk's File No.
N- 275729 of the Real Property Records of Harris County, Texas.
THENCE North 76 deg 30 min 56 sec East with the North line of this
tract of land, at 20.04 feet the Southeast corner of said 20 foot
drainage easement, in all a total distance,of 297.50 feet to a 1/2
inch iron rod found for the Northeast corner of this tract of land.
THENCE South 09 deg 55 min 44 sec East with the East line of this
tract a distance of 698.30 feet to a 1/2" iron rod found for the
Southeast corner of this tract of land in the South line of said
26.4431 acre tract of land and in the North right of way line of
Interstate Highway No. 10.
THENCE South 76 deg 30 min 56 sec West with the South line of this
tract the South line of said 26.4431 acre tract of land and the
North right of way line of Interstate Highway No. 10 a distance of
297.50 feet to THE PLACE OF BEGINNING, containing within said
boundaries 4.76 acres of land.
EXHIBIT A
SUMMARY
• Size of Area: The area proposed for annexation consists of
approximately 4.76 acres.
•
Proposed Land-Use: The subject site is anticipated to be developed
commercially including an automobile dealership.
Impact: As a result of this proposed annexation, no additional
city facilities, vehicles, or personnel will be required. For fire
protection purposes, the project site will be assigned to Fire
District Three.
Means of Accomplishment The annexation will be accomplished from
the existing city limit line along IH -10.
Public Input: Public Hearings are scheduled for October 8, 1992 at
6:45 p.m. and 7:00 p.m. in the City of Baytown City Hall Council
Chambers.
Attachments: Attached to this summary are the specific Service
Plan elements submitted by each of the major city departments. The
originals of these documents are on file in the City ClerkIs
office.
