ORDINANCE NO. 6422
• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, ESTABLISHING A PRIMA FACIE SPEED LIMIT
OF 30 MILES PER HOUR ON TRI -CITY BEACH ROAD FROM ITS
INTERSECTION WITH TEXAS AVENUE TO ITS INTERSECTION
WITH SPUR 55; ESTABLISHING A MAXIMUM PRIMA FACIE SPEED
LIMIT OF 20 MILES PER HOUR FOR MOTOR VEHICLES IN
ELEMENTARY AND JUNIOR SCHOOL ZONES; DESIGNATING
ELEMENTARY AND JUNIOR SCHOOL ZONES; PROVIDING FOR
HOURS OF ENFORCEMENT ON SCHOOL DAYS; AUTHORIZING AND
DIRECTING THE PLACEMENT OF SIGNS BY THE DIRECTOR OF
PLANNING AND TRAFFIC; REPEALING ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE;
PRESCRIBING A MAXIMUM PENALTY OF FIVE HUNDRED AND
N01100 ($500.00) DOLLARS; AND PROVIDING FOR THE
PUBLICATION AND EFFECTIVE DATE HEREOF.
WHEREAS, pursuant to Sec. 168, Art. 6701D UNIFORM ACT
REGULATING TRAFFIC authorizing alteration of maximum prima facie
speed limits with respect to streets and highways within the
corporate limits of the City of Baytown based upon engineering
and traffic investigations and requested public hearings; NOW
THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That a prima facie maximum speed limit with
respect to Tri -City Beach Road from its intersection with Texas
Avenue to its intersection with Spur 55 is established at 30
miles per hour and the City Council hereby determines and
declares this prima facie speed limit to be reasonable and
prudent.
Section 2: That a special hazard exists to traffic safety
in the vicinity of elementary and junior schools on days when
school is in session and at times when students and other traffic
approach and depart from the vicinity of such schools and the
City Council hereby makes such findings and determines and
declares that the maximum prima facie speed limit to be
reasonable, prudent and lawful is 20 miles per hour at the times
and places designated in Exhibit "A" attached hereto and
incorporated herein for all purposes.
Section 3: The Director of Planning and Traffic is hereby
authorized and directed to cause the proper signs to be posted at
the above described locations.
Section 4: It shall be unlawful for a driver of a motor
vehicle to disobey the instructions of the signs placed in
accordance with the provisions of this ordinance, unless at the
• time otherwise directed by a police officer or traffic control
device.

• Section 5: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed, provided however, that such repeal shall be only to the
extent of such inconsistency and in all other respects this
ordinance shall be cumulative of other ordinances regulating and
governing the subject matter covered by this ordinance.
Section 6: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the remaining provisions of this ordinance or their application
to other persons or set of circumstances and to this end all
provisions of this ordinance are declared to be severable.

Section 8: This ordinance shall take effect from and after
ten (10) days from its passage by the City Council. The City
Clerk is hereby directed to give notice hereof by causing the
caption of this ordinance to be published in the official
newspaper of the City of Baytown at lease twice within ten (10)
days after passage of this ordinance.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown this 22nd day of October,
1992.
